	1. Information on how to enter and information on prizes forms part of these Conditions of Entry. 2. Entry is only open to individuals of Australian residency who hold an Australian Dollar consumer or small business American Express Card issued by the Promoter in Australia, or issued in Australia by any licensee of American Express Limited. Cardmembers who hold an American Express Corporate Card, Government Card or Corporate Purchasing Card are not eligible to enter. Employees of the Promoter and their agencies associated with this promotion, and their immediate families, are ineligible to enter. 3. Every Card transaction in the retail, lodging or the restaurant industry debited to an American Express Card account during the Promotional Period will automatically represent one entry in the draw. Any Card transaction occurring at a merchant which has entered the American Express 'Win A Mercedes-Benz - Merchant' Promotion will represent three entries in the draw. The total transactions of participants will be retrieved at the end of the Promotional Period and entered into the draw. 4. Promotion commences 01/06/05 and closes 5pm AEST on 30/09/05 ("Promotional Period"). The draw will take place at Legion Interactive, Level 9, 100 William Street, East Sydney NSW 2010 on 27/10/05 at 3pm. Winner will be notified by mail and telephone, and the winner's name will be published in The Australian on 03/11/05. 5. The Judges' decision is final and no correspondence will be entered into. 6. The first valid entry drawn will win Mercedes-Benz C200K. The total value is up to $72,500 and includes the cost of the vehicle, metallic paint, stamp duty, dealer delivery, on road costs and registration (inclusive of GST). 7. Total prize value of the Promotion is up to AUD$72,500. The Promoter accepts no responsibility for any variation in any prize value. Prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full. 8. No responsibility is accepted for late, lost or misdirected entries. 9. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian. 10. The Promoter may conduct such further draws at the same place as the original draw as are necessary on 24/02/06 at 3:00pm ("Unclaimed Prize Draw") in order to distribute any prizes unclaimed by that date, subject however to any written directions given under relevant lottery legislation. In the event of a winner in the Unclaimed Prize Draw, their name will be published in The Australian on 02/03/06. 11. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law. It is a condition of accepting the prize that the winner (and companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 12. If for any reason this competition is not capable of running as planned for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any written directions given under relevant lottery legislation) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the competition. 13. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including but not limited to any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition. 14. The Promoter reserves the right to request the winner to provide proof of identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter. 15. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any written directions under relevant lottery legislation) to cancel, terminate, modify or suspend the promotion. 16. Privacy Consent. To provide this competition, the Promoter needs to collect personal information about the entrant. If the entrant does not provide the information requested, the Promoter may not be able to provide the entrant with the competition entry. The American Express Privacy Policy Statement sets out policies on management of personal information. To arrange access to personal information about entrant, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to the Promoter. The entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following: Disclose entrants' personal information to State and Territory lottery departments; publish winners' names as required under the relevant lottery legislation; use the winner's personal information in any media for publicity purposes associated with the competition, including sending the entrant electronic messages without any further payment or other compensation. 17. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. 18.
