Subject to the Terms and Conditions of the Membership Rewards program. American Express reserves the right (at its sole discretion) to discontinue an item or to substitute a similar item of equal value. Cardmembers will be advised of any change in merchandise status at the time of placing their order. These rewards are only available to Australian enrolees who reside in Australia.


GIFT FINDER

The contents of this site is subject to the Terms and Conditions of the Membership Rewards program. Information in this site is correct at October 2009. Rewards available and point values stated are not negotiable. American Express will endeavour to ensure the availability of all items except where occasions may arise that will make some items unavailable. In such cases, American Express reserves the right (at its sole discretion) to discontinue an item or to substitute a similar item of equal or greater value. If Cardmembers are redeeming through the call centre they will be advised of any change in merchandise status at the time of placing their order. In cases where the redemption has taken place online and the redemption item is no longer available the redemption item will be automatically substituted with the product’s direct replacement and the Cardmember will be notified by postal mail. If any delay in delivery is expected the Cardmember will also be notified by phone or postal mail. These rewards are open only to Australian dollar Cardmembers who reside in Australia. Unless otherwise stated, additional products shown in images of rewards are for demonstration purposes only, and are not included as part of the reward. If redeeming with Points + Pay, the ‘pay’ component of your reward will be automatically billed to your Primary Card Account and will appear on the first billing statement following redemption.
Merchandise may take up to 14 business days for delivery. Should you not receive your Merchandise reward within the stated timeframe, you must advise American Express within 28 days from date of redemption in order to claim your reward. Claims made after 28 days will not be investigated or processed. Unless otherwise advised, rewards will be delivered to your statement address between 9am and 5pm, Monday to Friday. If no one is home, a calling card will be left so you are able to collect from your local post office. If you’d prefer delivery to a business address, please include the business name when placing your order. Merchandise and Gift Cards over the value of $600 can’t be delivered to a PO box. Please provide a home address, or a work address that includes a business name for registered post and courier purposes. Please note that rewards cannot be delivered outside Australia.


GIFT CARDS

Gift Card or voucher rewards are not redeemable or exchangeable for cash or credit and are valid for a period of three months from the date of issue, unless otherwise stated. Normal retailer Gift Card and voucher conditions apply. Please allow 5 working days for Gift Cards to be delivered. Should you not receive your Gift Card reward within the stated timeframe, you must advise American Express within 28 days from date of redemption in order to claim your reward. Four Points Gift Cards:
This voucher is valid for use at participating Starwood Hotels & Resorts* in Australia only. This voucher can be used as part or full payment for accommodation, food and beverage or any other services provided by the hotels to the value indicated. Any unused portion of this voucher will not be refunded. This voucher may be used as part of payment for higher amounts than its face value by paying the difference with an alternative payment method. This voucher may not be exchanged for cash, used as a deposit on a sales agreement, or used as a method of paying vendor accounts. This voucher is not transferable and must be presented in conjunction with a valid American Express card. This voucher has no cash value and will not be replaced if lost or stolen. This voucher is not valid in conjunction with any other special programs (including Starwood Privilege), convention rates, packages, tour weekend rates, promotional rates etc.

Prior booking is essential and subject to availability; some blackout dates may apply. Gift Vouchers are not exchangeable or redeemable for cash or credit and must be used by the expiry date printed on the voucher. All values are in Australian Dollars. All bookings are to be made directly with the hotel.

Westin Gift Cards:
This voucher is valid for use at participating Starwood Hotels & Resorts* in Australia only. POINTS FOR CREDIT

Subject to the Terms and Conditions of the Membership Rewards program. Points may be redeemed by the basic Cardmember for a credit on the Primary Card Account. We may decline a Points for Credit request, at our discretion, where the Card Account or Cardmember’s other accounts with American Express are not in good standing. The redemption of Points for Credit will be administered solely by us within 3 business days and cannot be reversed. Points for Credit is not available for redemption by Corporate Card accounts and is not redeemable for cash via credit balance refund.


REWARDS CONCIERGE

Subject to the Terms and Conditions of the Membership Rewards program and availability of the reward. Return of rewards or items still in "as sold” condition will not be accepted as part of this service (hence section of Clause 8.8 of the Membership Rewards Terms and Conditions does not apply). Members are unable to change or cancel orders after points have been redeemed or payment made. Rewards Concierge is available to select Cardmembers who have over 100,000 points.


AMERICAN EXPRESS® REDEEM TO WIN COMPETITION

1. Information on how to enter and prize details form part of these terms and conditions. If there is any conflict between these terms and conditions and any other published material, these terms and conditions are to prevail.

2. The promoter is American Express Australia Limited ABN 92 108 952 085, 12 Shelley Street, Sydney, NSW ("The Promoter”)

3. Entry is open to permanent residents of Australia who hold an eligible American Express Card that is billed to an Australian address and issued by the Promoter in Australia, whose account is current and in good standing and is a participating member of the Membership Rewards program("Eligible Entrant”). Directors, employees and their immediate families of the Promoter and Pinpoint Pty Ltd are ineligible to enter.

4. An eligble American Express Card is considered to be any American Express card which is enrolled within the Membership Rewards, Australia program

5. The competition opens at 12:00 a.m. Eastern Daylight Savings Time on 5 October 2009 and closes at 11:59 p.m. Eastern Standard Time (EST) on 4 December 2009 ("Competition Period").

6. A redemption made for Merchandise, excluding but not limited to all Airline transfers, denominational voucher and gift cards, accommodation and travel vouchers or related redemption, concierge service redemptions, credit and/or fee rebate redemptions will be classified as an "Eligible Redemption”.

7. To automatically receive one entry into the competition an Eligible Entrant must redeem accumulated points for an Eligible Redemption during the Competition Period.. One entry will be awarded per Eligible Entrant. Eligible Entrants may receive multiple entries into the competition. Eligible Entrants can only win one prize.

8. Merchandise rewards will be available for Redemption via the Membership Rewards website, or via the Membership Rewards Call Centre (From anywhere within Australia 8 a.m. to 8 p.m. Monday to Friday, and 9 a.m. to 5 p.m. Saturday and Sunday, EST ) by calling 1300 363 276.

9. There will be 1 prize draw with 202 separate prize packs consisting of :



Total Prize pool is valued at AUD $19,782.50 inc. GST.

10. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST) . The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

11. Prize Draw will take place at the premises of Pinpoint Pty Ltd of 100-104 Reynolds Street, Balmain NSW on 16th December 2009 12:00 p.m. EST. Winners will be selected by random selection from a computer database containing all Competition Entries.

12. An Entrant whose American Express Account is in arrears (i.e. the minimum monthly payment not having been paid for a period greater than 30 days) will not be considered an Eligible Entrant and another entry will be drawn. The first Eligible Entrant will be awarded the Major prize, with following Eligible Entrants awarded Secondary prize and Supplementary prizes.

13. The prize draw winner of the Major Prize and Secondary Prize will be notified and sent their Prize (if applicable) to an Australian residential address by 24th December 2009. Major Prize and Secondary Prize Winners’ names will be printed in the public notices section of The Australian newspaper on 18th December 2009 and notified by mail.

14. Each Winner indemnifies the Promoter against any liability, injury, loss or damage which may be suffered, incurred or sustained by American Express arising out of, relating to, or in any way connected with, any act or omission (including negligence) by the Winner, or the use of the Prize, or any breach of these terms and conditions.

15. The Promoter reserves the right to redraw in the event of a Winner being unable to satisfy these terms and conditions, or forfeiting through ineligibility or otherwise. For a prize that remains unclaimed or is forfeited through ineligibility or otherwise, the Promoter will conduct a further draw at the same time and place as the original draw on 26th March 2010 subject to any written directions given under Regulation 37 of the Lottery and Gaming Regulations 1993 (SA).

16. The Promoter’s decision is final and no correspondence will be entered into.

17. The Promoter accepts no responsibility for any variation in any prize value. Prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full.

18. If a prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

19. No responsibility is accepted for late, lost or misdirected entries.

20. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

21. The Promoter and/or Prize provider shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law.

22. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. Cancelled redemptions are not eligible to be entered into the draw.

23. The Promoter and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and Cardmembers should seek their own independent financial advice.

24. If for any reason this competition is not capable of running as planned for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any written directions given under relevant lottery legislation) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the competition.

25. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.

26. The Promoter reserves the right to request the winner to provide proof of identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter.

27. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any written directions under relevant lottery legislation) to cancel, terminate, modify or suspend the promotion.

28. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.

29. Privacy Consent. To provide this competition, the Promoter needs to collect personal information about the entrant. If the entrant does not provide the information requested, the Promoter may not be able to provide the entrant with the competition entry. The American Express Privacy Policy Statement sets out policies on management of personal information. To arrange access to personal information about entrant, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to the Promoter.
