‘5 Return Trips for 2 to L.A’ Promotion
CONDITIONS OF ENTRY
- Information on how to enter and information on prizes forms part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these conditions of entry.
- Entry is only open to individuals of Australian residency, who are the Primary Account Holder of an Australian Dollar consumer or small business American Express Card issued by American Express Australia Limited (the “Promoter”) or by any Licensed Network Partners of American Express Limited (“Eligible Entrant”). Entrants must also be Velocity Members. Cardmembers who hold an American Express Corporate Card, Business Travel Accounts, Government Card or Corporate Purchasing Card are not eligible to enter.
- Employees of the Promoter, its licensees, their agencies associated with this promotion, and their immediate families, are ineligible to enter.
- To enter the Promotion, Eligible Entrants must transfer a minimum of 2,000 Membership Rewards™ points to Velocity during the Promotional Period. Each Eligible transfer during the promotional period will represent one (1) entry in the draw. Only Primary Account Holders are eligible to claim a winning prize.
- Under the Membership Rewards Ascent program, a minimum of 2,000 Membership Rewards points may be transferred to Velocity at any one time and must be transferred in whole numbers.
- Promotion commences 09:00 (AEST) Wednesday 9 July 2008 and concludes at 23:59 (AEST) Wednesday 30 September 2008 (“Promotional Period”).
- There will be 5 prizes of 2 V Australia business class return flights (including taxes, fees and surcharges) from Sydney to Los Angeles to be given away. All 5 prize draws will be conducted at the end of the Promotional Period valued at AU$20,000 each.
- An Eligible Entrant will only be eligible to win one (1) of the prizes. SA residents are entitled to win more than one prize, subject to state regulation.
- The computerised random draw will take place at Belong , Level 8, 155 George St Sydney 2000 on Wednesday 10/10/2008 at 0900 (AEDST). Winners will be notified by via mail, or email and telephoned. Winners’ names will be published in The Australian on Thursday 16/10/2008.
- It is a condition of acceptance of the prize that the winning Entrant’s credit account must be current (during the Promotional Period and at the time of the draws) and the winning entrant must not be in default under their credit contract.
- All prize flights are in Z class and are subject to booking and flight availability and must be taken by 30 December 2009. Prize flights may not be available during school holidays, public holidays or peak periods.
- Velocity Points will not form part of any prize and will not be earned on prize flights. Prize flights are subject to the V Australia terms and conditions of carriage and contract and any other restrictions as outlined by V Australia when awarding prizes.
- Total maximum prize pool including taxes is valued at up to AU$100,000.
- The Promoter’s decision is final and no correspondence will be entered into.
- The Promoter accepts no responsibility for any variation in any prize value. Prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full.
- No responsibility is accepted for late, lost or misdirected entries.
- The Promoter may conduct such further draws at the same place as the original draw as are necessary if prize(s) remain unclaimed, in the event of a prize being unclaimed, an unclaimed prize draw will occur at 15:00 (AEDST) on Monday 16 January 2009 (”Unclaimed Prize Draw”) at Belong offices, level 8, 155 George St Sydney 2000],subject to any directions given under relevant lottery legislation and under Regulation 37 of the Lottery and Gaming Regulations, 1993 (SA). Winners name will be published in The Australian on Thursday 29 January 2009.
- The Promoter and/or Prize provider shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law.
- The Promoter and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and Cardmembers should seek their own independent financial advice.
- If for any reason this competition is not capable of running as planned for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any written directions given under relevant lottery legislation) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the competition.
- The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
- The Promoter reserves the right to request the winner to provide proof of identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter.
- In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any written directions under relevant lottery legislation) to cancel, terminate, modify or suspend the promotion.
- Privacy Consent. To provide this competition, the Promoter needs to collect personal information about the entrant. If the entrant does not provide the information requested, the Promoter may not be able to provide the entrant with the competition entry. The American Express Privacy Policy Statement sets out policies on management of personal information. To arrange access to personal information about entrant, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to the Promoter. The entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following:
- Transfer personal information confidentially to the Promoter’s related companies or organisations that provide services in relation to this competition. This includes transferring personal information to the USA or other countries for data processing and servicing;
- Disclose entrants' personal information to State and Territory lottery departments;
- Publish winners' names as required under the relevant lottery legislation; and
- use the winner's personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies the Promoter at time of accepting the prize.
- V Australia flights are anticipated to commence in December 2008, and are subject to regulatory approval.
- Travel insurance, accommodation, meals and other incidentals are not included as part of this prize and are the prizewinners responsibility.
- Prizes are not transferable or redeemable for cash.
- Velocity Membership and Points redemption are subject to Velocity Terms and Conditions. The Velocity Program is operated by Velocity Rewards Pty Ltd ABN 98 116 089 448 as trustee of The Loyalty Trust. Velocity Rewards Pty Ltd and V Australia are the prize provider for this competition and are not responsible for, or involved in, the conduct of the competition, the draw and / or the allocation of prizes.

CONDITIONS OF ENTRY

- The Promoter is American Express Australia Limited (ABN 92 108 952 085) of 12 Shelley Street, Sydney, NSW 2000 (“Promoter”).
- Entry is only open to individuals of Australian residency, who are the Primary Account Holder of an Australian Dollar consumer or small business American Express Card issued by the Promoter or by any Licensed Network Partners of American Express Limited (“Eligible Entrant”). Cardmembers who hold an American Express Corporate Card, Business Travel Accounts, Government Card or Corporate Purchasing Card are not eligible to enter.

- Promotion commences 00:01 (AEST) Wednesday 9 July 2008 and closes at 23:59 (AEST) Sunday 31 August 2008 (“Promotional Period”).
- To enter the Promotion, Eligible Entrants must redeem on any non-air category goods or services, including merchandise, points for credit, rewards concierge or retail gift vouchers during the Promotional Period. Redemptions made with airline reward partners, frequent guest programs or points for travel are not included in the promotion. Each redemption made during the promotional period will represent one (1) entry in the draw. Only Primary Account Holders are eligible to claim a winning prize.
- There will be 10 Prizes of 100,000 points to be given away to the value of up to $1,000 each. All 10 winners will be drawn at the end of the Promotional Period. Entrants can enter as many times as they like, however prizes are limited to one per person.
- The computerised random prize draws will take place at Belong Pty Ltd,, Level 8, 155 George St Sydney NSW 2000 on Friday 18 September 2008 at 9:00 (AEST). Winners will be notified by mail and telephoned within 10 days of the prize draw. Winners’ names will be published in The Australian on Thursday 2 October 2008.
- It is a condition of acceptance of the prize that the winning Entrant’s credit account must be current (during the Promotional Period and at the time of the draws) and the winning entrant must not be in default under their credit contract.
- The prize must be taken as offered and cannot be varied. Prizes will be awarded within 28 days, but may not be visible on customer accounts for 8 – 10 weeks. Respective rewards programs’ Terms & Conditions apply.
- Total maximum prize pool is valued at up to AU $10,000. (including GST)
- The Promoter’s decision is final and no correspondence will be entered into.
