Contest Rules & Regulations

  1. Contest period runs from October 1, 2004, at 12:01am EST to December 31, 2004, at 11:59pm EST inclusive. To enter and be eligible to win, you must be an American Express Basic Cardmember and enrolled in the Membership Rewards Program, a resident of Canada, of the age of majority in your province or territory of residence and not an employee of, a member of the immediate family of or domiciled with an employee of Amex Bank of Canada, Amex Canada Inc., The Keg Steakhouse & Bar, Famous Players, ROOTS Ltd. or the independent contest organization, and their respective subsidiaries, affiliates, or agents.

  2. During the contest period each time you redeem Membership Rewards points for a “Day on the Town Combo” consisting of a Famous Players Night Out Package (2 adult admissions, 1 popcorn and 2 soft drinks), a Keg Steakhouse & Bar $50.00 certificate and a ROOTS $50.00 certificate, you will automatically receive one entry into the contest. No purchase necessary. To enter without redeeming, you may submit your full name, address, telephone number and Membership Rewards Program account number on a 3” X 5” plain piece of paper and mail it to: Flicks, Food & Fashion Contest, Amex Bank of Canada, 101 McNabb Street, Markham, Ontario, L3R 4H8. Enter as often as you wish but each postal entry must be mailed separately, bear sufficient postage and be received no later than December 31, 2004, the contest closing date.

  3. There will be one prize package awarded, consisting of one (1) Famous Players Big Card (Approximate retail value $1500.00) entitling the holder to one year worth of unlimited movies at any Famous Players Theatre for him/herself and a guest, a ROOTS $1000.00 Shopping Spree awarded in ROOTS gift certificates and $1000.00 in Keg Steakhouse & Bar gift certificates.

  4. A random selection will be made in Saint John, NB at 2.00 pm AST on January 29, 2005 from all entries received (automatic and non purchase) on or before the contest closing date. Selected entrant will be telephoned at a telephone number indicated in the records of Amex Bank of Canada or, in the case of non purchase entries, the telephone number(s) indicated on the non purchase entry, one or more times at the discretion of Amex Bank of Canada over a 7 day period, from or after January 29, 2005. No telephone messages will be left. If the selected entrant cannot be reached at the indicated telephone number(s) within 7 days, a letter will be sent by registered mail to the address where the billing statements are sent or, in the case of the no-purchase entries, to the address provided, requesting that the selected entrant contact the contest agent. If, after 7 days, no response has been received from the selected entrant, the prize will not be awarded in respect to that selected entry and another contest entry will be randomly selected and so on until the prize has been awarded. In order to win, the selected entrant must first correctly answer, unaided, a time-limited, arithmetical, skill-testing question to be administered by telephone at a mutually convenient time. The odds of being selected depend upon the total number of eligible entries received.

  5. In order to receive his/her prize, the winner must execute, without compensation, and in the form required by Amex Bank of Canada in its discretion, a release and a consent for the use of his/her name and/or photograph and/or address (city only) for advertising, publicity and promotional purposes in all media, including but not limited to within americanexpress.ca. By entering the contest, the contestants agree to abide by the contest rules and the decisions of the independent contest organization which are final.

  6. By participating, entrants agree to release, discharge and hold harmless Amex Bank of Canada, Amex Canada Inc., their respective employees, officers, directors, parent, affiliates, subsidiaries, advertising and promotion agencies, agents and representatives from any and all injuries, liability, losses and damages of any kind resulting from their participation in the contest or their acceptance, use or misuse of the prize. Amex Bank of Canada, Amex Canada Inc., their respective officers, directors, parent, affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective employees are not responsible for and shall not be liable for (a) any electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; (b) failed, incomplete, garbled or delayed computer transmissions; (c) lost, late, misdirected, incomplete or incorrect entries; or (d) any condition caused by events beyond the control of Amex Bank of Canada that may cause the promotion to be disrupted or corrupted. Amex Bank of Canada reserves the right in its sole discretion to cancel or suspend the contest or any portion thereof should virus, bugs or other causes beyond the control of Amex Bank of Canada corrupt the administration, security or proper play of the promotion. Entry information becomes the property of Amex Bank of Canada.

  7. Any litigation from Québec residents respecting the conduct or organization of this publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Contest is subject to all applicable Federal, Provincial and Municipal laws.
