SWEEPSTAKES PROGRAM ("SWEEPSTAKES")
("GENERAL TERMS AND CONDITIONS")


1.
Eligibility
1.1..
Sweepstakes are open only to all American Express® Charge and Credit (the "American Express Card") Cardmembers (the "Cardmembers"), including all Cards issued by American Express International, issuing banks around the world and those by PT. Bank Danamon Indonesia Tbk. located in Jakarta, and are subject to these General Terms and Conditions.
1.2.
American Express Card account must be in good standing (not overdue or in collection) and not otherwise have privileges suspended.
1.3.
Employees of PT. Bank Danamon Indonesia Tbk. ("Bank Danamon") and their immediate families (spouses, parents, children, and siblings and their respective spouses) and their respective branch offices, subsidiaries, affiliates, distributors, advertising and promotion agencies, partners in the Sweepstakes and their immediate family members (collectively, "Released Parties") are not eligible.
         
2. Timing
  The Sweepstakes begins on 1 April 2008 and ends on 31 December 2008 (the "Promotion Period").
         
3. How to Enter:
  3.1.
Every Rp. 100,000 (one hundred thousand Rupiah) qualifying transaction in Indonesia using American Express Card made during the Promotion Period is automatically entered in the Sweepstakes. Multiples apply.
  3.2. Entry is ineligible in respect of the following transactions:
    3.2.1.
Account adjustment transactions/returns, Cash Advance and other cash services; Express Cash or Emergency Cheque Cashing; American Express Travelers Cheque purchases; American Express Gift Cheque or Travel Gift Certificate purchases; charges for dishonored cheques; finance charges: Credit Card Account finance charges; late payment and referral charges, tax refunds from overseas purchases; Balance Transfer; and tax refunds from overseas purchases are not considered eligible transactions for the Sweepstakes entry.
    3.2.2. Entries from unauthorized Card use or made with lost, stolen, or fraudulent Cards are void.
         
4. Type of Prizes:
  4.1.
There are 50 (fifty) holiday packages of free trip to Bali for two inclusive of accommodation (the "Prize 1") and 3 (three) holiday packages to East Java and Bali for two inclusive of accommodation (the "Prize 2"), from originating cities (hereafter referred as the "Prizes") during the Promotion Period. Prizes are subject to the following terms and conditions:
    4.1.1. Inclusions of Prize 1:
      - 2 (two) return economy class tickets from originating cities to Bali, as set out in clause 4.2.
      - 4 (four) nights accommodation as set out in clause 4.3.1.
    4.1.2. Inclusion of Prize 2: 2 (two) return business class tickets from originating cities to East Java and Bali, as set out in clause 4.2. 8 (eight) nights accommodation as set out in clause 4.3.2.
  4.2. Air tickets:
    4.2.1.
Air tickets are direct flight to Prizes destination cities by Garuda Indonesia or any other carriers (if there is no flight by Garuda Indonesia)
    4.2.2.
In the case there is no direct flight to Prizes destination cities, transit to be conducted at the nearest regional hub where there is a direct flight to Prizes destination cities.
    4.2.3.
Domestic return tickets are borne by Bank Danamon for trips originating and ending in capital cities of Indonesia's provinces. Additional transportation to and from those cities are solely winners' responsibilities.
    4.2.4.
International return tickets are paid by Bank Danamon for trips originating and ending in the following cities only. Additional flights to and from those cities are solely winners' responsibilities.
      i). Africa: Johannesburg - South Africa.
      ii). Southeast Asia: Bandar Sri Bagawan - Brunei; Bangkok - Thailand; Kuala Lumpur - Malaysia; Manila - Philippines; Singapore.
      iii). East Asia: Beijing,Guangzhou, Shanghai - China; Fukuoka, Tokyo Japan; Hong Kong; Seoul - South Korea; Taipei - Taiwan.
      iv). South Asia: Chennai - India
      v). Australia/ Oceania: Auckland - New Zealand; Melbourne, Perth, Sydney Australia
      vi). Europe: Frankfurt - Germany; London - United Kingdom; Rome - Italy
      vii). Middle East: Dubai - United Arab Emirates
      viii). North America: Los Angeles, New York, San Francisco - USA
      ix). South America: Buenos Aires - Argentina
      Additional flights to and from the above mentioned cities are solely winners' responsibilities.
    4.2.5.
Return tickets are 30 (thirty) day tickets, not valid for stay over, non refundable, non transferable and subject to availability.
    4.2.6.
No air tickets will be issued for winners reside in prize destination cities.
    4.2.7.
Additional fees or charges for overstay and change of schedule shall be born by winners.
    4.2.8.
Fulfillment of flying is until 10 December 2009. Non-compliance with any of the foregoing may result in disqualification.
    4.2.9.
Winners from overseas are responsible for all necessary travel authorizations, such as passports and visas, for any travel insurance, for any local government taxes and for all trip expenses not specified in these General Terms and Conditions.
  4.3. Accommodations
    Accommodations comprise of:
    4.3.1.
Prize 1:
     
Complimentary 4 (four) night stay at Singaraja Room - InterContinental Resort Bali
     
Included in this package are: transfer from Ngurah Rai Airport - InterContinental Bali Resort - Ngurah Rai Airport; daily breakfast for 2 (two); concierge/ lounge facility; 1 (one) time Theta Spa by The Sea-60 (sixty) minutes Island Massage spa treatment for 2 (two); transfer of InterContinental Bali Resort - Theta Spa InterContinental Bali Resort; and 1 (one) time - (halo day guided tour to Ubud for 2 (two).
 
Accommodation is subject to availability, certain restrictions, and the following blackout dates may apply: 15 July - 15 September 2008; 26 September - 12 October 2008; 23 December - 10 January 2009; 23-28 January 2009; 8-12 April 2009; 15 July - 15 September 2009; 26 September - 12 October 2009; 23-24 December 2009.
      Fulfillment of staying is until 22 December 2009. Non-compliance with any of the foregoing may result in disqualification and Prize 1 will be forfeited.
    4.3.2. Prize 2:
      Complimentary 8 (eight) night stay at Tugu Hotels in East Java and Bali.
      Included in this package are:
      i). Hotel Tugu Malang
       
Transfer from Juanda International Airport - Surabaya to Hotel Tugu Malang; 3 (three) night accommodation at one of the following suites (depending on availability): Zamrud, Babah or Devata Suites; welcome drink & welcome massage for 2 (two); 2 (two) times afternoon high-tea for 2 (two); daily breakfast for 2 (two); 1 (one) time dinner for 2 (two); 1 (one) city tour to Malang and surroundings for 2 (two); 1 (one) x 2 (two) hours full body massage for 2 (two); and transfer to Hotel Tugu Blitar.
      ii).
Hotel Tugu Blitar
       
2 (two) night accommodation at Tugu Suite; welcome drink for 2 (two); daily breakfast for 2 (two); guided tour to key attractions nearby for 2 (two); 2 (two) times afternoon high-tea for 2 (two); 2 (two) times dinner for 2 (two); transfer to Juanda International Airport.
      iii).
Hotel Tugu Bali
       
Transfer from Bandara Ngurah Rai - Bali to Hotel Tugu Bali. 3 (three) night accommodation at either Dedari or Rejang Suites; welcome drink for 2 (two); daily breakfast for 2 (two); 2 (two) times afternoon high-tea for 2 (two); 2 (two) times dinner for 2 (two); guided tour to key attractions nearby for 2 (two); 1 (one) time spa treatment for 2 (two) at Waroeng Djamoe Spa and/ or Theta Spa; and transfer to ke Ngurah Rai Airport - Bali.
     
Accommodation is subject to availability, certain restrictions, and the following blackout dates may apply: 15 July - 31 August 2008, 20 December 2008 - 5 January 2009, 15 July - 31 August 2009, 20 Desember 2009.
     
Fulfillment of staying is until 19 December 2009. Non-compliance with any of the foregoing may result in disqualification and Prize 2 will be forfeited.
  4.4.
Winners will be responsible for all other expenses not specifically set forth herein including but not limited to additional ground transportation, shore excursions, gratuities, souvenirs, any other incidentals and items of a personal nature.
  4.5.
Winners will require to make a reservation through the following Bank Danamon's appointed travel agent:

5. Winners Selection
  5.1.
Winners will be selected/ drawn by an independent judging organization in front of a notary every 3 (three) months. The first drawing will be conducted in the fourth month since the launch of the Sweepstakes. Subsequent drawings will be held 3 (three) months after the last drawing.
  5.2.
Winners will be selected in a random drawing from among all eligible transactions/ Cardmembers who are in compliance with the General Terms and Conditions of the Sweepstakes. Winner's found to be ineligible or not in compliance with these Terms and Conditions will be disqualified and an alternate winner may be selected.
  5.3.
In the first and second drawing, there will each be 17 (seventeen) winners of Prize 1 and 1 (one) winner of Prize 2. There are 16 (sixteen) winners of Prize 1 and 1 (one) winner of Prize 2 in the third drawing event. Each Cardmember will be allowed to win once in each drawing period. Decisions will be final and binding in all matters.
  5.4. Winning list will be posted on a number of above the line media one week after each drawing event.
  5.5.
Within 3 (three) calendar days after the drawing event, Bank Danamon will issue winner notification ("Notification"), which will be distributed to either Cardmember directly or through Global Network Services of American Express International Inc.
   
Inability to contact a winner, the return of Notification as undeliverable, or winner's found to be ineligible or not in compliance with these Terms and Conditions. After 15 (fifteen) calendar days of the issuance of Notification, will result in disqualification and an alternate winner may be selected.
  5.6.
All sweepstakes winners will be required to execute an affidavit of eligibility, and compliance with the General Terms and Conditions and a publicity/ liability release ("Confirmation") within 15 (fifteen) days of attempted Notification prior to issuance of travel documents. In the event of non compliance within the time period, winner will be disqualified and an alternate winner may be selected.
  5.7. Winners must be able to provide proof of valid identity upon being requested by Bank Danamon.
  5.8.
Prizes cannot be transferred, redeemed for cash, and there will not be any substitution of prizes (or portion thereoo accept by Bank Danamon due to prize unavailability.
  5.9. Winners of Prizes shall be one of traveling parties.
  5.10.
In the event that Sweepstakes is considered illegal by the law of winner's home country, Bank Danamon reserves the right to re-draw the entries and select a winner without prior notice.
  5.11. Winners agree to be bound by these Terms and Conditions and agree that:
    5.11.1.
Bank Danamon and Released Parties and their designees shall have the right and permission to use (unless prohibited by law) their name, voice, city/state of residence, and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission, or notification; and
    5.11.2.
Bank Danamon and Released Parties and their designees and assigns and all of their respective officers, directors, employees, shareholders, representatives and agents shall have no liability and will be held harmless for any liability, loss, injury or death to winners, or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize (including any travel or prize activity related thereto) or participation in this Sweepstakes.
         
6. General Conditions
  6.1. Bank Danamon is not responsible for and shall not be liable for:
   
i). telephone, electronic, hardware or software program, network, computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human or other error which may occur in the processing of entries, or the incorrect or inaccurate capture of entry information, or the failure to capture, or loss of, any entry or other information; ii). failed, incomplete, garbled, interrupted, corrupted, or delayed computer transmissions; iii). printing, typographical or other errors; iv). late, lost, misdirected, illegible or incomplete entries, or postage-due mail; or v). any condition caused by events that may cause the promotion to be disrupted or corrupted. Bank Danamon reserves the right in its sole discretion to cancel or suspend the promotion or any portion thereof should hardware or software malfunctions (such as but not limited to virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures) or other causes corrupt the administration, security or proper play of the promotion, in which case the prizes will be awarded via a random drawing from among all eligible entries received prior to the action taken, or in such other manner as deemed fair and appropriate by Bank Danamon.
  6.2.
Bank Danamon is not responsible for quality goods or services supplied pursuant to these General Terms and Conditions. Bank Danamon is indemnified and held harmless from and against all costs, claims, demands, or losses of whatever nature arising from a breach this clause.
  6.3.
The obligations of Bank Danamon shall be suspended to the extent and for the period that performance is prevented by any cause beyond its reasonable control, including but not limited to, acts of God, laws, regulations, orders or proclamations of any governmental entities, judgments or orders of any court of law, acts of war whether declared or undeclared, riot, civil strife, labor disputes, explosions, fires, earthquakes, volcanic eruptions or other natural calamities.
  6.4.
Particularly for Indonesian winners, prize tax and all expenses related to acceptance and use of prizes and not specified herein as being awarded are winners' sole responsibility. Bank Danamon has the right to directly charge on Prizes tax to winners' American Express Cards (after receiving Confirmations from the winners).
  6.5.
Bank Danamon reserves the right to amend these General Terms and Conditions at any time without prior notice.
  6.6. The Sweepstakes is subject to all applicable laws and regulations of Republic Indonesia.
  6.7.
In the absence Confirmation being received by Bank Danamon within 60 (sixty) calendar days of the issuance date of Notification, Prizes will be donated to Ministry of Social of Republic Indonesia, as set by applicable rules.
  6.8.
If there is any difference between English text of these General Terms and Conditions and the Bahasa Indonesia text, the Bahasa Indonesia text should for all purpose be considered definitive.
         
Beware and be cautious of any frauds which may be performed by any party who misused of Bank Danamon's brand and offering prizes. Bank Danamon shall not liable for any fraudulents or misconducts performed by any other third party related to this Sweepstakes.
