TRAVELLERS CHEQUE CARD FROM AMERICAN EXPRESS® CARDHOLDER AGREEMENT

[Issued either in Sterling, US Dollar, or Euro]

This Cardholder Agreement ("Agreement") governs your use of the Travellers Cheque Card (the "Travellers Cheque Card" or "Card") issued in the United Kingdom by American Express Bank Ltd., which carries on the business of banking. ("Travellers Cheque Card" or "Card" includes "Additional Card", if applicable). By signing or using the Travellers Cheque Card, you are agreeing to the terms and conditions of this Agreement (the "Terms and Conditions"). In this Agreement, the terms "you", "your" and "Cardholder" refer to the Travellers Cheque Cardholder or, where applicable, any Additional Cardholder; that is, the person to whom a Travellers Cheque Card was issued and whose signature appears on it. The terms "we", "our", "us", and "American Express" refer to American Express Bank Ltd. Operational services for the Travellers Cheque Card are provided by the following American Express companies: American Express Travel Related Services Company, Inc., World Financial Center, 200 Vesey Street, New York, NY 10285, USA; American Express Europe Limited, Amex House, Edward Street, Brighton, BN88 1YR, UK (head office and branch address) FC 011790, BR000897; American Express Service Europe Limited, Registered Office: Belgrave House, 76 Buckingham Palace Road, London, SW1W 9AX. Registered Number 1833139, together ("Amex").

This Agreement supersedes and replaces any previous or other agreement relating to the Card, which agreement shall immediately be cancelled and of no further effect. Any sums outstanding from you to us under any previous agreement shall be deemed to have been incurred and to be outstanding under this Agreement.

THE TRAVELLERS CHEQUE CARD

The Card is a prepaid card intended for use whilst travelling. It is not a credit card, charge card or debit card. You must load funds onto the Card before it can be used. Cards are available in three currencies: Sterling, US Dollar, and Euro. You are only allowed to have (i) one currency on each Card purchased by you and (ii) one Card (plus Additional Cards) for each available currency or Cards purchased by you. The Card is an Electronic Money ("E-money") product, and as such it is not covered by the Financial Services Compensation Scheme. Unless specifically stated otherwise, the following Terms and Conditions apply to Cards issued in any of the three currencies.

You can choose (i) to purchase a Card for yourself, with or without Additional Cardholders; or (ii) to purchase a Card for Additional Cardholders only and not for yourself. In both cases, you are responsible for loading, reloading and any shortages, together with any applicable fees or charges.

The maximum total number of Cards which you can purchase or hold (including any Additional Cards purchased by you or for you by another person) is twelve (12).The value of the funds that are loaded onto the Card and are available for spending are referred to in this Agreement as the "Available Funds". No interest will be paid to you with respect to such Available Funds. As the Card is used, the Card's Available Funds will be reduced by the full amount of each purchase or automated teller machine ("ATM") transaction, plus taxes, charges and other fees, if any. The Card may not be used for any amount that exceeds the Available Funds or after the "valid thru" date printed on its face.

APPLYING FOR THE CARD

Our issuance of a Travellers Cheque Card to you or at your request is based on the information you have provided in the application process. We reserve the right (i) to accept or decline your application for a Card; and (ii) to cancel or terminate your Card and/or any Card purchased by you at any time. You must be a UK resident (this does not include residents of the Channel Islands or the Isle of Man) aged 18 years or older to apply for a Card. Additional Cards may be issued to persons aged 13 years or over. You agree (i) to provide personal information in the application process that is accurate and complete; (ii) to update your personal information as necessary so that it remains accurate and complete; and (iii) not to impersonate any other person, operate under an alias or otherwise conceal your identity.

When you apply for a Travellers Cheque Card, you must indicate an Initial Load Amount which must be at least £200 and no more than £3000 (or the US Dollar or Euro equivalent).For non-personalised Cards, the Initial Load Amount is the aggregate of the pre-denominated base load and any additional top-up at purchase chosen by you. An Issuance Fee may apply when you first load a Travellers Cheque Card, whether you purchase the Card by telephone, online at www.americanexpress.co.uk/travellerschequecard or at a designated Travellers Cheque Card seller ("Seller") (see "Limits and Fees for Travellers Cheque Card" below).

In addition to any Issuance Fee, when you purchase a Travellers Cheque Card in a currency other than Sterling (for example, if you purchase a Travellers Cheque Card loaded with Euro), the Initial Load Amount, and any Reloads (as defined in the section below entitled "Reloading the Card"), will be converted from Sterling to the currency of the Travellers Cheque Card. Currently, the conversion rate we use for initial loads and Reloads is 4% above the Amex Foreign Exchange ("FX") rate for those two currencies at the time of such conversion. For Cards loaded or reloaded at Sellers other than Amex, each Seller may set its own FX conversion rates, which may differ from those used by Amex or by other Sellers.

In applying for a Travellers Cheque Card you acknowledge that: (i) the Financial Services Compensation Scheme does not apply to the Travellers Cheque Card; and (ii) in the unlikely event American Express should become insolvent, the E-money on your Travellers Cheque Card may lose its value and become unusable and accordingly you may lose your E-money.

ADDITIONAL CARDS

For each available currency, you may have up to three (3) Additional Travellers Cheque Cards ("Additional Cards") issued to persons you know and have designated and consider suitable to use the Card ("Additional Cardholders"). Additional Cardholders must be 13 years or older. You agree that you have informed your Additional Cardholders how to use the Additional Cards and of the terms of this Agreement, and you certify that they have agreed to such terms. Additional Cards may be cancelled by you or us at any time. You are responsible under this Agreement for the use of Additional Cards by the persons you have designated. In the event that any of the Additional Cards that you have requested are used improperly, creating any Shortages (as defined in the section below entitled "Consequences of Transactions in Excess of Available Funds"), you will be responsible for such Shortages, together with any applicable fees or charges. All Additional Cards have a minimum Initial Load Amount of £200 (or the US Dollar or Euro equivalent). The total amount of Available Funds on the Additional Cards and your Cards cannot exceed £3,000 at any time. If you are an Additional Cardholder, you agree to be bound by these Terms and Conditions.

BEFORE USING THE CARD

Before the Card can be used, you must (i) activate the Card; (ii) accept the Terms and Conditions; and (iii) where you have purchased a Card for yourself, sign your name in permanent ink on the reverse of the Card, where indicated. You will be asked to accept the Terms and Conditions and acknowledge the risk warning contained in the paragraph "Applying for the Card" when you call to activate your Card. Where you have purchased a Card for yourself, you will also be given the opportunity to select a PIN at time of activation.

You should keep your personal identification number ("PIN") and a record of your Card number separately from the Card in case the Card is lost or stolen (you will need the PIN to use your Card at an ATM) (see "ATM Transactions" below). You must keep your PIN secure and you must not disclose your PIN to anyone. You should also keep a separate record of the Customer Service telephone number so that you can contact us in the event that your Card is lost or stolen.

You must activate your Card or, where you have not purchased a card for yourself, the Card and accept the Terms and Conditions before any Additional Cardholders will be able to activate his or her own Card. Additional Cardholders must follow the activation procedure set out above in respect of such Additional Cards.

For security, during the activation call we may request some additional verification information from you. Such data will be held in confidence and in accordance with the Terms and Conditions. You agree to provide the data as reasonably requested. If you do not wish to provide the data, or if the data you provide cannot be appropriately verified, we reserve the right to cancel your Card and reimburse you (for this purpose, not including an Additional Cardholder) for the Initial Load Amount and the Issuance Fee within ten (10) business days, by electronic transfer to an account with a bank/building society or to the nearest contractually affiliated money transfer facility or to the credit, debit or charge card account which you used to purchase that Card from American Express or by cheque.

RELOADING THE CARD

You may reload your Card or any of your Additional Cards by paying additional amounts ("Reloads") with the payment method you have designated. To do this you should call the Customer Service number which appears on your Card:

You may also reload your Card at the Seller where you purchased your Card or online at www.americanexpress.co.uk/travellerschequecard The minimum Reload amount is £50 (or the US Dollar or Euro equivalent). You must reload in the same currency as that which was originally loaded on the Card. We reserve the right to decline any Reloads at our discretion.

The total amount of Available Funds on your Card (if applicable), together with any other Additional Cards you may have requested, cannot exceed £3000 at any time. In addition, you may not reload more than £3000 on your Card (if applicable), together with any Additional Cards you may have requested, in any fourteen (14) day period.

The funds that you reload during business hours will usually be available within the day you communicate your Reload instructions to us and we have accepted those instructions. However, under some circumstances the funds may not be available until the next business day.

You agree that when reloading by telephone or online, we are authorised to charge all Reloads (and any other applicable fees or charges as detailed in the section entitled "Limits and Fees for Travellers Cheque Card" below), to the payment method you designate. If you reload your Card at any Seller, you will be required to pay their applicable fees or charges.

If an Additional Cardholder wishes to reload the Additional Card you have given them, using his or her own funds/account, then that person must either call Customer Service, return to the original Seller or go online to www.americanexpress.co.uk/travellerschequecard The amount of that Reload, together with Available Funds on that Additional Card, cannot exceed £3000 (or the US Dollar or Euro equivalent). To do this, the Additional Cardholder must be 18 years or older. The Additional Cardholder will have to provide additional information including account information (see "Applying for the Card" above). After an Additional Cardholder has reloaded his or her Card using his or her own account, he or she will then be responsible for his or her Card and any resulting Shortages (see "Transactions in Excess of Available Funds" below). Moreover, the amount loaded onto that Additional Card will no longer be taken into account in calculating the £3000 load limit which applies to your Card (if applicable), together with any other Additional Cards you may have requested.

USING THE CARD

The Travellers Cheque Card is NOT a credit, charge or debit card. The Card must first have funds loaded onto it. Once loaded, the Card can be used at virtually every establishment that accepts American Express cards (an "Establishment"). Some restrictions apply (see the section entitled "Usage Limitations" below). You can also access the funds that have been loaded on your Card at any of the ATMs which participate in the ATM network maintained by American Express. To obtain cash from ATMs you will need to use your PIN, which you will be asked to select when you activate your Card (see "ATM Transactions" below).

To use the Card at an Establishment, simply present the Card at the time of payment, and sign the receipt with the same signature you used when you signed the Card. You should retain the receipt as a record of the transaction for balance tracking purposes. Depending on the Establishment's policy, you may be able to use your Card with another form of payment to make a purchase for an amount greater than the Available Funds on your Card. Before you attempt to make such a transaction please ensure you know the amount of your Available Funds. If the Establishment agrees to allow you to pay by a combined payment, pay the difference first with the Available Funds on your Card and then use another form of payment accepted by the Establishment to pay the remaining balance.

You agree:

  • That American Express is authorised to deduct the amount of your purchases, together with any other fees, taxes, or charges from the funds you have loaded on your Card whenever your Card is used to make purchases or to obtain cash through ATMs in accordance with our instructions or in accordance with this Agreement.
  • To track your spending and not exceed the Available Funds on your Card.
  • Not to use the Card after the "valid thru" date printed on its face.
  • Not to permit any other person to use the Card issued to you.
  • Not to use the Card at those Establishments or for those purposes described in the section below entitled "Usage Limitations".
  • To notify us at once if the Card is lost or stolen (see the section entitled "Lost/Stolen Cards" below).

If for any reason you receive a refund to your Card from an Establishment, for example if you have returned goods, you agree to accept the credit to your Card in lieu of cash. Your ability to obtain a refund or to return goods purchased depends on the Establishment's return policies. There may be a delay of up to seven (7) business days after we receive the refund details from an Establishment before any amounts refunded to your Card are available for spending, dependent on the timing of the Establishment's settlement of credits.

Please note that purchases made with the Card are similar to those made with cash or Travellers Cheques. You cannot "stop payment" or lodge a "billing dispute" on such transactions. Any problems or disputes you may have regarding the transaction should be addressed directly to the Establishment (see the section entitled "Problems with Purchases" below).

USAGE LIMITATIONS

Cards are prepaid cards. Consequently, certain limitations apply to their use. In particular, in certain circumstances some Establishments, such as petrol stations, might access funds on your Card in excess of the sums you actually plan to spend. Such Establishments would do so in order to cover variable costs like a tank of petrol or tips. Such over-authorised funds will be marked against your Card for a short period of time until the authorisation is cancelled, at which time the funds will become available. For this and other reasons, Cards are not intended for use in certain industries. You are NOT permitted to use the Card:

  • To reserve a rental car, or when picking up a rental car. However, at the end of a car rental, you can use your Card to pay for the rental.
  • To reserve a hotel/motel room, or when checking into a hotel/motel or other lodging establishment. However, at the end of your stay, you can use your Card to pay for your stay.
  • To pay for petrol "at the pump" through automated terminals. However, you can use your Card to pay for petrol by presenting the Card in the station or to a service station attendant.
  • To pay for "person-to-person" internet payment products.
  • To pay for telecom charges (including cellular, airplane telephones, payphones, home phone service, etc.)
  • To pay for recurring charges, such as health club memberships or subscriptions.
  • To make instalment payments in the future for goods/services received in the present.
  • To pay for bail bondsmen.
  • To pay for detective agencies.
  • To pay for home repair services such as plumber, electrician, or painter/decorator.
  • To pay for internet electronic services including electronic mail, internet service provider, internet telecom, etc.
  • To pay for personal services such as escort agencies, introduction services, or massage parlours.
  • To pay for wholesale goods.
  • To pay for on-board cruise or train charges and some in-flight purchases.
  • To pay for gambling.

We reserve the right to add additional Establishment or purchase categories to this list at any time in the future.

Please note that the service offered by some American Express Travel Offices to encash a personal cheque guaranteed by an American Express Card (Emergency Cheque Cashing), is NOT available for the Card.

ATM TRANSACTIONS

You must have a PIN to use the Card at an ATM. To select your PIN or to obtain information on the locations of participating ATMs, please call Customer Service at the number listed above.

You may use your Card to obtain up to £250 per day (or the US Dollar or Euro equivalent) from any ATMs in the American Express network. Use of the Card at ATMs is subject to availability, surcharges, rules and customs of any clearing house, ATM network, or other institution or association involved with the transaction. We reserve the right, with or without notice and for reasonable cause, to deny authorisation for any ATM transactions. In addition, we will charge to your Card an ATM Fee per ATM transaction. In calculating the £250 ATM daily withdrawal limit we will not include any fees for such withdrawals (including the American Express ATM Fee). This fee will be debited as a separate transaction from the ATM withdrawal.

Please note that if in any one day, you reach the daily ATM withdrawal limit, you can still use the Card to purchase goods and services at an Establishment, subject to the amount of your Available Funds.

If you believe that there is an error regarding the amount of funds deducted from your Card at an ATM, you must notify us immediately by calling Customer Service, and no later than sixty (60) days from the date of the transaction. You must tell us your Card number, the date and amount of the error, and describe the error and explain as clearly as you can why you believe there is an error. If we ask you to provide this information in writing, you agree to do so within five (5) business days (to American Express Bank Ltd., 60 Buckingham Palace Road, London SW1W 0RR, for the attention of the Compliance Officer). We will investigate and will notify you of receipt of your report within five (5) business days and the results of our investigation within thirty (30) business days.

INFORMATION ABOUT AVAILABLE FUNDS

You should keep track of the amount of your Available Funds. We suggest that you use the transaction log included in the welcome pack. To check the Available Funds at any time, you may either call Customer Service or log on to www.americanexpress.co.uk/travellerschequecard. You may also request information about previous transactions by calling Customer Service. Our records of your Available Funds will reflect all transactions that have been posted to our system.

If you request a paper statement of your Card transactions, we reserve the right to charge a Paper Statement Fee for processing and posting the statement to you. Paper statements can only be requested by a Cardholder (for these purposes not including an Additional Cardholder) by calling Customer Service.

If you believe that there is an error regarding any transaction posted to your Card you must notify us immediately by calling Customer Service, and no later than sixty (60) days from the date of the transaction. You must tell us your Card number, the date and amount of the error, and describe the error and explain as clearly as you can why you believe there is an error. If we ask you to provide this information in writing, you agree to do so within five (5) business days (to American Express Bank Ltd., 60 Buckingham Palace Road, London SW1W 0RR, for the attention of the Compliance Officer). We will investigate and will notify you of receipt of your report within five (5) business days and the results of our investigation within sixty (60) business days.

LOST/STOLEN/DAMAGED CARDS

You should treat your Card as if it were cash and keep it secure at all times. If your Card is lost, stolen, damaged or used improperly, or if your Card ceases to function properly, contact us immediately at Customer Service. You will be asked to provide us with the Card number and identifying details regarding recent purchases. If our records show that there are still Available Funds remaining on the Card, we will cancel and/or replace the Card and refund, where appropriate, such Available Funds to you, usually within 24 hours. If you subsequently find or retrieve a Card which you have reported lost or stolen, you must notify us immediately.

If money is fraudulently transferred to your Card by unauthorised withdrawals from any of your accounts before you tell us it has been lost, stolen or misused, the most you will lose on your Card is £50. You will not lose anything on your Card if money is transferred from any of your accounts to your Card after you have told us it has been lost or stolen or that someone else knows your PIN. American Express will return your funds to you, at its discretion, either by issuing you a new Card, electronic transfer to your bank/building society account or the nearest affiliated money transfer facility, crediting your credit, debit or charge card which you used to purchase that Card from American Express or issuing a cheque to you.

If any of your Available Funds are lost or stolen from your Card as a result of it being lost, stolen, damaged or used improperly or ceasing to function properly you may file a claim for a refund of such amount. We reserve the right to investigate all requests for a refund, and to decline the refund. In addition, payments of refunds are subject to the following requirements:

Before Loss:
  • You have signed the Card on its reverse side in permanent ink.
  • You have not given the Card to another person or company to hold or to keep or as part of a confidence game.
  • You have not used the Card in a fraudulent way or in violation of any law including as part of any illegal bet, game of chance or other prohibited action.
  • Your Card has not been taken by court order or by government action.
  • Taking into account the Available Funds amount, you have safeguarded the Card as a prudent person would safeguard a like amount of cash.
  • You have taken reasonable care to safeguard your Card from misuse.

After Loss:
  • You immediately notify us of the loss, theft or other problem with your Card.
  • You report all facts of the loss, theft or other problem with your Card to us (and also to the police if we ask you to).
  • You inform us of the number of your Card and the approximate date and place of its purchase.
  • You complete our refund forms and provide us with acceptable proof of your identity if requested.
  • You give us all reasonable information and help requested to make a complete investigation of the loss, theft or other problem with your Card.

PROBLEMS WITH PURCHASES

In the event you have a dispute about the nature or quality of goods or services you have purchased with the Card, you may contact Customer Service and we will provide you with any transaction information we may have. However, it is your responsibility to deal directly with the Establishment to resolve the matter.

PROHIBITION OF TRANSACTIONS IN EXCESS OF AVAILABLE FUNDS

You should not attempt to use the Card for a transaction if there are insufficient Available Funds for the transaction in question. It is your responsibility to keep track of your spending on the Card and of your Available Funds. You may contact us for information on the amount of Available Funds on your Card (see "Information About Available Funds" above).

CONSEQUENCES OF TRANSACTIONS IN EXCESS OF AVAILABLE FUNDS

If you attempt to use the Card when there are insufficient Available Funds for the transaction in question, the transaction in most instances will be declined. If, due to a systems malfunction or for any reason whatsoever, a transaction occurs when there are insufficient Available Funds on the Card for that transaction, your Available Funds will become a negative amount, referred to in this Agreement as a "Shortage".

You agree that once we make this Shortage known to you, we may:

  • Charge the amount of the Shortage to your designated payment method (which we will hold in our records) or to any other payment method which you may designate at that time;
  • refuse to accept Reloads to your Card; and
  • cancel your Card and any Additional Cards

In addition, we reserve the right to charge you a Shortage Fee per transaction whenever you either create or enlarge the Shortage on your Card (see the section entitled "Limits and Fees for Travellers Cheque Card" below). You agree that we may contact you or bill you for any such amount, and you also agree that we may, at our discretion, offset any such amount against any Available Funds which may thereafter exist on your Card or on any Additional Card you ordered. Subject to applicable law, American Express may pursue its costs of collecting any Shortage from you.

In the event that a Shortage remains due and owing to us for more than seventy (70) days despite our written request for payment, you agree that we shall be entitled to exchange information about you and/or your use of the Card with consumer reporting agencies which information they may share with other organisations in connection with assessing applications from you or members of your household for credit or for preventing fraud or tracing debtors.

"VALID THRU" Date

Please note that the Card has a "valid thru" date indicated on the face of the Card. That is the date after which that Card may not be used. If you would like to renew your Card, simply contact us prior to the "valid thru" date and we will reissue a Card for a Reissuance Fee (see the section entitled "Limits and Fees for Travellers Cheque Card" below). However, exceeding the "valid thru" date does not mean the Available Funds on the Card have expired. If Available Funds remain on the Card after the "valid thru" date, you should contact us within three (3) months by calling Customer Service for instructions on how to renew your Card or redeem the Available Funds. If we have not heard from you by the end of the three (3) month period, the Available Funds will be reimbursed to you (for these purposes, not including an Additional Cardholder) on request.

Alternatively, if you wish, you may at any time redeem the Available Funds in excess of 10 Euro (or Sterling or US Dollar equivalent) and cancel your Card (and any Additional Cards), though we reserve the right to charge a Cancellation/Redemption Fee (see the section entitled "Limits and Fees for Travellers Cheque Card" below). In this instance, American Express reserves the right to hold funds for fifteen (15) business days before redeeming any such Available Funds. Any redemptions on an Additional Card can only be paid to a Cardholder (for these purposes not including an Additional Cardholder). American Express will pay such redeemed Available Funds in the manner described in the section below entitled "Cancellation/Redemption". You may leave Available Funds on the Card until the "valid thru" date and may contact us at any time to redeem them. You can always cancel your Card and any Additional Cards at any time before the "Valid Thru" date shown on the Card (see the "Cancellation/Redemption" section below).

TRAVELLERS CHEQUE CARD ADDITIONAL BENEFITS

Cardholders currently have access to two additional services:

  • Passport Replacement Assistance Service - Provides replacement assistance 24 hours a day, 7 days a week through our Customer Service Centre if you lose your passport.
  • Credit/Debit Card Replacement Assistance Service - Provides credit and debit card cancellation and replacement assistance 24 hours a day, 7 days a week through our Customer Service Centre if you lose your credit/debit cards. Service applies to American Express Cards and credit and debit cards issued by major banks only. Other types of cards such as retail store, petrol, calling cards and frequent flier cards are not covered by the replacement assistance service.

Proof of current Travellers Cheque Card ownership may be required before services are provided.

Credit/Debit Card Replacement Assistance and Passport Replacement Assistance services include: providing to the Travellers Cheque Cardholder the necessary telephone contact numbers for passport and/or credit/debit card replacement; when requested, transferring the Cardholder's call to such contact numbers; and providing other available information to assist the Cardholder in the replacement process. Any fees associated with Passport Replacement Assistance and/or Credit/Debit Card Replacement Assistance (such as passport replacement fees, government fees, expediting agency fees, etc.) are the sole responsibility of the Travellers Cheque Cardholder.

American Express reserves the right to change and amend any services that are provided in conjunction with the Travellers Cheque Card, including adding new services and cancelling existing services. Such changes may be made without advance notice.

TRANSACTIONS MADE IN FOREIGN CURRENCIES

If you make a transaction with your Card in a currency other than your Card currency (for example, if you use a US Dollar Card to make a purchase in Euro), the transaction will be converted into your Card currency on the date it is processed by us or our agents as follows:

  1. Unless a particular rate is required by applicable law, you understand and agree that our treasury system will use conversion rates based on Interbank rates that it selects from customary industry sources on the business day prior to the processing date, increased by a single conversion commission of 4.5%.
  2. For Cards loaded in Sterling or Euro, if the transaction is not in US Dollars, the conversion will be made through US Dollars, by converting the transaction amount into US Dollars and then by converting the US Dollar amount into Sterling or Euro as appropriate. If the transaction is in US Dollars, it will be converted directly into Sterling or Euro as appropriate.
  3. In all cases the conversion rate may differ from rates in effect on the date of your Card transaction and if charges are converted by third parties prior to being submitted to us, any conversion made by those third parties will be at rates selected by them.

No currency conversion occurs where transactions are incurred in the currency loaded on your Card.

LIMITS AND FEES FOR TRAVELLERS CHEQUE CARD

Here is a summary of all fees, charges and limitations for Cards, depending on the currency of the Card:

NO WARRANTY OF AVAILABILITY OR UNINTERRUPTED USE

In the event that the Card service becomes inoperative, you may be unable to reload funds onto your Card, obtain information about Available Funds on your Card and Card transactions, or use your Card to pay for purchases. Please notify us if you have any problems using your Card. You agree that American Express is not responsible for any interruption of service.

NO WARRANTY REGARDING GOODS AND SERVICES

American Express is not responsible for the quality, safety, legality, or any other aspect of any goods or services purchased by you with your Card.

REFUSAL OF CARD

American Express will not be liable for failure of any Establishment to honour the Card.

CHANGING THESE TERMS AND CONDITIONS/CARD CANCELLATION

We may change the terms of, or add new terms to this Agreement at any time and we may suspend, cancel, add, modify or delete any feature offered in connection with your Card at our sole discretion at any time, with or without cause, by giving you reasonable written notice.

If we cancel your Card, any Available Funds remaining on the Card upon such cancellation after payment for all of your transaction and applicable fees will be returned to you (for these purposes, not including an Additional Cardholder).. We reserve the right to make it a condition of reimbursement that your Card is returned to us, in the event that the Card has not expired. The Card is the property of American Express.

YOUR RIGHT TO WITHDRAW

If you have purchased your Card online or on the phone, you (for these purposes, not including an Additional Cardholder) have the right to withdraw from this Agreement and cancel your Card (and any Additional Cards) within fourteen (14) days of activation without penalty or charge. You must contact us within fourteen (14) days by calling Customer Service and inform us of your wish to withdraw. We will cancel (deactivate) the Card (and any Additional Cards) and reimburse you (for these purposes, not including an Additional Cardholder) the amount of any Available Funds, together with any Issuance Fee charged, after fifteen (15) business days. We reserve the right to hold funds up to fifteen (15) business days before returning your balance to ensure all transactions have been received.

After this fourteen day period you may cancel your Card at any time as described below.

CANCELLATION/REDEMPTION

You (for these purposes, not including an Additional Cardholder) may also cancel your Card and redeem any Available Funds on the Card at any time by notifying Customer Service. We will cancel (deactivate) the Card and reimburse you (for these purposes, not including an Additional Cardholder) the amount of any Available Funds, in excess of 10 Euro or Sterling or US Dollar equivalent, remaining on the Card after fifteen (15) business days and after deducting the applicable Cancellation/Redemption Fee (see the section entitled "Limits and Fees for Travellers Cheque Card" above).

To redeem the funds on your Card you (for these purposes, not including an Additional Cardholder) can either obtain cash via an ATM or if you wish you can phone Customer Service and we will make an electronic transfer to an account with a bank/building society or to the credit, debit or charge card account which you used to purchase that Card from American Express or we will issue a cheque to you. We reserve the right to hold funds up to fifteen (15) business days before redeeming Available Funds to ensure all transactions have been received. In the event that additional charges or fees are incurred on your Card, we reserve the right to contact you and/or bill you for any such amount that is deemed a valid transaction, whether incurred before or after notification to cancel. We reserve the right to make it a condition of reimbursement that your Card is returned to us, in the event that the Card has not expired.

The minimum redemption amount is 10 Euro (or Sterling or US Dollar equivalent).

Where the Card has expired, please refer to the section entitled '"Valid Thru" Date' above.

ASSIGNMENT

We may assign the benefit of this Agreement at any time without notice to you. However, if we assign the benefit of this Agreement, the terms of this Agreement will remain substantially and materially the same unless you are notified.

In the event that we reimburse you for a refund claim you have made or if we otherwise provide you with a credit or payment with respect to any problem arising out of any transaction made with the Card, you are automatically deemed to assign and transfer to us any rights and claims (excluding tort claims) that you have, had or may have against any third party involved with that transaction for an amount equal to the amount we have paid to you or credited to your Card. You agree that you will not pursue any claim against or reimbursement from such third parties for the amount that we paid or credited to your Card, and that you will cooperate with us if we decide to pursue any such third party for the amount paid or credited.

If we do not exercise our rights under this Agreement, we do not give up our rights to exercise them in the future.

COMPLAINTS AND COMPENSATION

Should you have any complaint, please contact us by calling Customer Service. If your complaint is not dealt with to your satisfaction, you may be able to refer it to the Financial Ombudsman Service (the "Ombudsman Service") if it is an eligible complaint under the rules of the Ombudsman Service. DATA PROTECTION AND PRIVACY

  1. We will disclose information about you, your application for the Card, your Card and charges on it (which may include details of goods and/or services purchased) to companies within the American Express group of companies worldwide, to companies who distribute the Card, to any other party whose name or logo appears on the Card issued to you, to any party authorised by you, to our processors and suppliers and to organisations who accept the Card in payment for goods and/or services purchased by you and obtain such information from said parties, in order to administer and service your Card, process and collect charges on it, manage any benefits and reconcile payments due by us to the above companies, processors, suppliers and organisations arising as a result of the issue of the Card to you and/or its use by you.
  2. We and other companies within the American Express group will use information about you, your Card and information about how you use your Card to develop lists for use in order that we or those companies may develop or make offers to you (by post), unless you ask us not to, of products and services in which you may be interested. The information used to develop these lists may be obtained from the Application form and process, from information on where you use and what charges are on your Card, from surveys and research (which may involve contacting you by post) and from information obtained from other external sources such as Establishments or marketing organisations.
  3. We may exchange information about you and your Card with credit reference agencies (whose names and addresses will be provided to you on request). This information may be shared with other organisations in assessing applications from you and members of your household for credit or other facilities and for preventing fraud and tracing debtors.
  4. In the event of a Shortage arising on your Card we may carry out credit checks (including contacting your bank or building society) and disclose information about you and your Card to collection agencies and lawyers for the purpose of recovering the amount of the Shortage on your Card.
  5. We may carry out further credit checks and analyse information about you and charges on your Card to assist in managing your Card, to authorise charges on it and to prevent fraud.
  6. We may check your details with fraud prevention agencies and if you give us false or inaccurate information and/or we suspect fraud, this will be recorded, which records may be used by us and other organisations to help make decisions about credit and credit-related services for you and members of your household, help make decisions on motor, household, credit, life and other insurance proposals and insurance claims from you and members of your household, trace debtors, recover debt, prevent fraud and manage your accounts or insurance policies.
  7. We may monitor and/or record your telephone calls to us, or ours to you, either ourselves or with the assistance of reputable organisations selected by us, to ensure consistent servicing levels (including staff training) and operation, and to assist, where appropriate, in dispute resolution.
  8. We will link and/or consolidate with other companies within the American Express group information about you and your Card with information relating to other group products and services which you may have used in order to manage, maintain and develop our overall relationship with you and to help us identify products and services in which you may be interested.
  9. We will undertake all of the above within and outside the UK and the European Union. This includes processing your information in the USA in which data protection laws are not as comprehensive as in the European Union. When you travel or make foreign purchases by post, e-mail, telephone or via the internet, American Express will also disclose to or access your information in other countries outside the European Union in which data protection laws may not be as comprehensive as in the European Union. In this case, American Express has taken appropriate steps to ensure the same level of protection for your information in the USA and other countries as in the European Union.
  10. We will undertake all of the above in respect of any Additional Cardholder on your Card. Where you have approved the issue of an Additional Card, you confirm that you have obtained the consent of the Additional Cardholder to disclose his or her information to American Express and process it for the above purposes.
  11. We use advanced technology and well-defined employee procedures to help ensure that your information is processed promptly, accurately, completely and securely. Therefore, in order to maintain the effectiveness and security of our technology systems and procedures, it will be necessary from time to time to process your information for testing purposes.
  12. We keep information about you only for so long as is appropriate for the above purposes or as required by applicable law. If you ask, we will tell you what information we hold about you and provide it to you in accordance with applicable law. There may be a charge for this, as permitted by law. If you believe that any information we hold about you is incorrect or incomplete, you should write without delay to the data controller (American Express Bank Ltd., 60 Buckingham Palace Road, London SW1W 0RR, for the attention of the Data Protection Officer). Any information which is found to be incorrect or incomplete will be corrected promptly.

OFFERS

We may develop marketing programs and send you offers for products and services that you may find of value. We do not share customer addresses with other companies (except other American Express companies) for them to market their own products and services.

Choice: If you prefer not to receive offers from American Express by post, you may let us know by calling Customer Service. If you opt out from receiving these offers, we may still send important information about the Card to you.

RIGHTS OF ADDITIONAL CARDHOLDERS

An Additional Cardholder has no right to enforce any of these Terms and Conditions under the Contracts (Rights of Third Parties Act) 1999.

NOTICES

Any notice given by us shall be deemed given when posted by us, postage prepaid, addressed to you at the latest address shown on our records.

LANGUAGE

This Agreement and all official communications with you, will be in English.

APPLICABLE LAW

These Terms and Conditions are governed by the laws of England and subject to the exclusive jurisdiction of the Courts of England and Wales.

Travellers Cheque Card was issued in the United Kingdom by American Express Bank Ltd. (“AEBL UK”). Effective 1 August, 2008, the business of AEBL UK (including the Travellers Cheque Card business in the United Kingdom) was transferred to Standard Chartered Bank.
