AMEX EXPRESS CHECKOUT TERMS

Amex Express Checkout is a service that enables you to retrieve your card details whilst purchasing online ("Express Checkout"). Express Checkout is provided by American Express Australia Limited ("American Express/we/us"), its agents and contractors.

Your use of Express Checkout is governed by and subject to these terms, the American Express Online Privacy Statement and our Website Rules & Regulations (the "Express Checkout Terms"). By using, logging-in or registering for the Express Checkout, you agree to these Express Checkout Terms.

1. Express Checkout  

Express Checkout enables you to retrieve your card account details, contact details, address as well as other personal information ("Payment Information") when you make a purchase online with a merchant who offers Express Checkout ("Express Checkout Merchant"). You can do this in two ways:

  • Auto Sign-Up: americanexpress.com.au User ID & Password  

    If you have an americanexpress.com.au User ID and Password ("Amex Credentials"), you can use those Amex Credentials to access Express Checkout and retrieve Payment Information that American Express already holds about you (such as, your American Express card details and billing address).

  • Manual Sign-Up: Bank issued American Express Cards   

    If you have a card issued by one of our bank partners  you can enter all of your Payment Information manually when you sign-up for Express Checkout. Your Payment Information will be stored within your personal Express Checkout profile ("Express Checkout Account").

    You must select a username and password ("Express Checkout Credentials"). Make sure you keep your Express Checkout Credentials confidential and not disclose them to anyone.

2. Your Payment Information 

i) Merchant’s Use of Your Payment Information  

When you use Express Checkout to make purchases at an Express Checkout Merchant, you direct us to share your Payment Information with that Express Checkout Merchant. American Express has no control over your Payment Information once it is transferred to the Express Checkout Merchant. American Express is not responsible for an Express Checkout Merchant’s use of your Payment Information and will not be liable to you for any loss you suffer as a result.

It is your responsibility to assess the Express Checkout Merchant’s privacy practices and to review the Express Checkout Merchant’s privacy policy. They may vary considerably from American Express’ policies and practices.

ii) Ensure Your Payment Information is Correct and Up to Date  

It is your responsibility to review your Payment Information before proceeding with your purchase and ensure that it is always up to date:

  • We are not responsible if the Express Checkout Merchant cannot process your purchase because you did not review your Payment Information and it is invalid, incomplete, inaccurate or out of date. You are responsible for keeping your Payment Information (such as your address) up to date.
  • If you have manually supplied your Payment Information within the Express Checkout and changes are made to your card or account details by your card issuer (for example, if your card is replaced), those changes are not updated in your Express Checkout Account. You must update your card details.

You should always ensure you have an alternative payment option available in case your purchase cannot be processed using Express Checkout.


iii) Unauthorised Use of Your Payment Information  

You must not share your Express Checkout Credentials or your Amex Credentials with anyone else and you must take reasonable steps to protect them. American Express is not responsible for any unauthorised use of your Payment Information if you have failed to comply with these Terms of Service.

Your card issuer may hold you responsible for any unauthorised use of Payment Information you have supplied and stored in the Express Checkout Account. It’s your responsibility to ensure you comply with your card terms and conditions at all times.

Notify Us & Your card Issuer

If you believe that anyone has accessed or used your Express Checkout Credentials, your Amex Credentials or your Express Checkout Account, or if you are aware of any fraudulent or suspicious activity, you must inform us and change your Express Checkout Credentials and your Amex Credentials immediately.

You should also inform all banks and financial institutions that issue your cards

3. Eligibility  

Not all cards are eligible for Express Checkout. David Jones Storecard, Small Business Cards for specific merchants, and Prepaid Travel Cards are not eligible.

To register for Express Checkout you must:

  1. be 18 years of age or older; and
  2. hold an eligible American Express charge or credit card issued to you (or which you have been authorised to use) with a registered billing address in Australia.

4. Your Use of Express Checkout  

You must use Express Checkout strictly in accordance with these Express Checkout Terms and only for your own personal use.

You must not allow anyone to use Express Checkout on your behalf or access Express Checkout using your Amex Credentials or Express Checkout Credentials.

If you are using Express Checkout on behalf of a company or business, you must be authorised to do so and you must be able to legally bind the company or business to these Express Checkout Terms.

5. Goods & Services you buy using Express Checkout 

American Express provides Express Checkout to make it easier for you to pay for goods and services online. You purchase those goods and services directly from the Express Checkout Merchant and not from American Express. You are ultimately responsible for making all payments to the Express Checkout Merchant.

We are not responsible for the sale of those goods and services in any way. The fact that you can use Express Checkout at a particular merchant does not mean that American Express endorses, recommends or sponsors the Express Checkout Merchant in any way.

If you require a refund, return or repair of any purchase, you should contact the Express Checkout Merchant. If you want to reverse a purchase, you may also wish to contact the bank or financial institution that issues your card.

6. Data Protection & Privacy 

Protecting your personal information is very important to us. We use your personal information including your Payment Information to provide you with access to the Express Checkout, to process transactions with Express Checkout Merchants and to communicate with you (including by email or mobile). We collect aggregated statistics based on your use of Express Checkout and we may share these statistics with some Express Checkout Merchants.

My Offers & Advertising

From time to time, you may be able to access promotions and offers in the Express Checkout by going to the 'My Offers' section. When you access 'My Offers', we will use your personal information, such as location, to decide which promotions and offers to present to you and sometimes, to tailor offers for you.

Your information may be transferred to other countries for processing, particularly where the Express Checkout Merchant is located overseas. We will process some of your information in the United States of America. 7. Prohibited Activities 

In connection with your use of Express Checkout, you must not:

  1. breach any applicable laws or regulations;
  2. engage in any fraud, deceptive or misleading conduct;
  3. provide us with false, invalid, out of date or inaccurate information (particularly when you register for Express Checkout);
  4. refuse to cooperate in any investigation;
  5. monitor or copy Express Checkout in any way;
  6. tamper with, interfere or access another person’s Express Checkout Account or Payment Information; or
  7. use Express Checkout in a way that interferes with or disrupts Express Checkout or another person’s use of Express Checkout.

8. Termination & Suspension of Use  

We may suspend or terminate your use of Express Checkout at any time if you breach these Express Checkout Terms. We will not be liable to you for any such suspension or termination. You may stop using Express Checkout at any time by deleting your Express Checkout Account and cancelling your registration.

9. Availability & Interruptions 

From time to time, you may not be able to access Express Checkout or your Express Checkout Account due to system failures, maintenance or repair. Sometimes, we may also need to limit your use of Express Checkout and impose transaction, volume or other limitations or restrictions to ensure that it runs efficiently for all users. We do not guarantee that Express Checkout or your Express Checkout Account will always be available and we are not responsible if you suffer any loss or damage due to such a lack of availability or service interruptions.

You should always ensure you have an alternative payment option available in case your purchase cannot be processed using Express Checkout.

10. Limitations and Exclusions of Liability 

We will not be liable for any loss or injury you suffer as a result of:

  1. Express Checkout being unavailable or Express Checkout being interrupted in any way. It is your responsibility to ensure you have an alternative payment option handy at all times;
  2. a data compromise event, fraud or security incident, provided we have taken reasonable steps to protect your Payment Information in compliance with applicable laws and regulations;
  3. any unforeseeable events or circumstances that are outside of our control;
  4. you not complying with these Express Checkout Terms or your own negligence; and
  5. anything done by an Express Checkout Merchant (for example, with your Payment Information).

11. Intellectual Property 

American Express owns all rights, title and interest in and to Express Checkout including without limitation all intellectual property rights. The trademarks, logos and service marks displayed on the Express Checkout website are the property of American Express. You must not modify, copy, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any portion of Express Checkout. You must not remove, obscure or alter the copyright notice, trade-marks or any other proprietary rights notices belonging to American Express and other third parties affixed to, contained within or accessed in conjunction with or through Express Checkout.

Any feedback or suggestions you provide in connection with the use of Express Checkout, including any survey responses or automatic feedback, will not be treated confidentially. American Express may share any feedback and suggestions with others and will not pay you any money for this.

12. Changes to Express Checkout & Terms  

We may withdraw Express Checkout at any time by giving you reasonable notice. We may make changes to Express Checkout without notice to you, unless those changes are detrimental to you.

American Express reserves the right to change the Express Checkout Terms at any time. We will update the "Last Modified" date and post the revised Terms of Use at Express Checkout Terms. Any changes to the Express Checkout Terms will take effect from the “Last Modified” date. By continuing to use Express Checkout after that date, you agree to the new Express Checkout Terms. If you do not agree, you should stop using Express Checkout.

13. Governing Law 

The Express Checkout Terms and your use of Express Checkout shall be governed by laws of New South Wales and the courts of New South Wales shall have jurisdiction.
