PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY ARE THE BASIS UPON WHICH BOOKINGS ARE ACCEPTED BY AMERICAN EXPRESS INTERNATIONAL (NZ) INC.

  1. Legal Contract
    When you (the person using this website) click to make a booking with us, legal obligations arise and your right to refund of monies charged to your American Express Card or paid in any other way agreed by us, are limited by our terms and conditions and by the conditions of the particular supplier. You must not make any booking through this website unless you understand and agree with all our terms and conditions.
  2. Changes to Terms & Conditions
    American Express (American Express) reserves the right to amend or change all or any part of the Terms and Conditions at any time. This includes amendments or changes to Policies on Additional Fees and Refunds.
  3. Liability
    By using American Express you agree that, subject to certain rights and remedies you have under the Fair Trading Act in New Zealand which cannot be excluded, restricted or modified, neither American Express International Inc. nor any subsidiary company or representative shall be liable for any loss, injury or damage to you or your belongings or otherwise arising in any way out of our services to you and American Express International Inc. excludes all other conditions and warranties implied by custom, law or statute.You acknowledge the following:

    If you request American Express to arrange for the provision of products or services by a person or company which is not licensed in accordance with any applicable law, American Express accepts no liability (whether in contract, for negligence or otherwise) for any loss or damage suffered by you or any third party as a result.
  6. Responsibility
    Products and services are sold by American Express as an agent for airlines, hotels and tour companies,,and any other suppliers providing travel related services on this website.

    American Express is not a provider of such travel related services and has no responsibility for such services provided or not provided by any party. Accordingly, by using these services in your booking, you agree to seek remedies directly with the supplier and, subject to applicable law, not to hold American Express nor its related companies, employees or representatives liable in contract or tort (actionable wrong) for any loss, costs, expense, injury, accident or damage to person or property caused directly or indirectly from either (a) the acts or omissions of such suppliers or (b) any event beyond American Express control including, but not limited to, war, civil disturbance, fire, flood, acts of God or Government or other authorities, accident to machinery or failure of machinery or equipment, or industrial action. All tickets, coupons, exchange orders, vouchers and receipts are issued subject to the appropriate tariffs and terms and conditions of sale of suppliers and these terms. American Express act as an agent and have no responsibility, and extend no guarantees for discontinued promotions, airfares or specific holiday products.

  7. Supplier's Conditions
    All coupons, receipts and tickets are issued subject to the terms and conditions specified by the suppliers. By accepting the coupons and tickets and utilising our services, you agree that, apart from certain rights you have under the Fair Trading Act that we cannot alter, neither American Express nor any subsidiary company or representative shall be liable for any loss, injury or damage to you or your belongings or otherwise arising in any way out of our services to you.
  8. Special Conditions for Airfares
    There are numerous rules and regulations affecting most discounted air fares, which involve substantial cancellation or amendment fees, and in some instances there are no refunds whatsoever on cancelled air tickets should you need to amend or cancel your travel plans. If you have any queries regarding these fees please do not hesitate to contact our office. You must read the rules and check the conditions applicable to every airfare and ensure that you accept those rules and conditions before you make a booking. If the rules and conditions are not displayed you should contact our office. Once you confirm a booking and make payment you are bound by the rules and conditions applicable stated by the relevant supplier.
  9. Special Conditions for Membership Rewards Travel
    The terms displayed on this website apply generally to all the products sold by American Express. Some travel related services also have special conditions applying to them. Airlines, hotels, tour operators and other suppliers have various other terms and conditions relating to the purchase of these goods and services. Some of which may involve substantial cancellation or amendment fees, and in some instances there may be no refunds whatsoever on cancelled travel related services should you need to amend or cancel your travel plans. Some of those terms will be displayed in the rules applicable to a particular product, but not all. For example, suppliers often limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage, however we do not have those conditions to display. It is your responsibility to check those terms and conditions before making a booking through American Express.
  10. Pricing
  11. 10.1. Goods and Services Tax
    All prices quoted include New Zealand GST for travel wholly within New Zealand.
    10.2. Payment
    Payment for online travel can ONLY be made using a New Zealand issued American Express card. The name on the credit or charge card used for the payment of any online transaction MUST correspond to the name of one of the passengers for which the relevant booking is made. Full payment is required at the time of booking. You acknowledge that American Express may receive a commission from transactions entered into using the service.
    10.3. Currency
    Unless specific otherwise, all rates and prices are quoted in New Zealand dollars, and as such are valid only for travel commencing in New Zealand. American Express regret that we cannot accept online bookings from customers residing outside New Zealand at this time.
    10.4. Rates and Price Variations
    American Express reserve the right to vary published rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you must pay the increase when notified. American Express are not liable in any way if any increase occurs. All prices are subject to availability and can be withdrawn or varied without notice.
    10.5. Price Inclusions and Exclusions
    All pricing and costs quoted are subject to change without notice due to airline/operator increases and/or currency fluctuations. Prices can only be guaranteed when paid in full and tickets and documents have been issued. Many countries have a departure tax which is additional to the price of your ticket. Please ensure you have sufficient local currency to pay for this at the airport. Items included in the prices or rates of the products are specified in each section. Prices do not include, meals other than as stated in itineraries, any air fares unless stated, Government departure taxes, passport and visa charges, vaccination fees, airport taxes, any items of a personal nature such as telephone calls, beverages, laundry, excess baggage charges and gratuities, travel insurance or other items not specified.
    10.6. Policies on Additional Fees and Refunds
    Please note, in the event of a booking amendment or cancellation, American Express reserve the right to apply the following service fees and conditions in addition to any charges assessed by the relevant airline and or supplier. a. Amendment Fee $50 per ticket b. Refunds Any applicable refunds will be credited to your original payment method. No cash refunds will be given.
  12. Availability
    The services sold through American Express are subject to availability and can be withdrawn without notice. Access to this website and any website normally linked to this website is not guaranteed and is subject to availability of communication links and access rights. American Express reserves the right to deny password login on this website to any person or password holder.
  13. Booking Acknowledgement
    Acknowledgment of your booking will be made via email and will include your booking reference. Please check your email regularly to ensure prompt receipt of any relevant communications. The fares shown on this website can be purchased only in conjunction with the website. American Express does not accept any responsibility for any loss incurred as a result of any failure of email delivery (irrespective of the reason for such failure).
  14. Passenger Name
    It is essential that you enter details of each traveller correctly and according to passport or other travel identification. Some suppliers will deny carriage if the traveller's name varies and your booking may be cancelled automatically if the traveller's name is amended. American Express accept no responsibility for any loss or damage arising from incorrect entry of traveller's name and any inability to travel as a result of carrier's policies. Each individual airline has their own policy regarding name changes and applicable fees.
  15. Fictitious or Duplicate Reservations
    American Express does not permit fictitious or duplicate reservations. If American Express establishes that an individual user has submitted and confirmed multiple identical bookings, we reserve the right to cancel one or all of the reservations immediately and without reference to the customer.
  16. Frequent Flyer Customers
    Please note if you are a frequent flyer member you should retain your air ticket and boarding pass as American Express will not obtain copies of your air ticket at any future date. American Express do not accept liability for points accrual or missing points. It is your responsibility to be familiar with the loyalty program of each airline with which you are an enrolled member.
  17. Flight Timings, Departure Points and Flight Numbers
  18. Check-in (Domestic): Please check-in at least 45 minutes prior for New Zealand domestic flights. Please refer to the respective airline/country policies for all other domestic flights. We suggest onward reservations and flight times are reconfirmed 72 hours prior to departure. Due to heightened security the airlines check-in time and reconfirmation policies may differ. Please check with your airline for the latest information.
    Check-in (International): Please check-in at least 2 hours (3 hours for U.S.A) prior to departure for international flights. Please refer to the respective airline/country policies for all other international check-in times. We suggest onward reservations and flight times are reconfirmed 72 hours prior to departure. Due to heightened security the airlines check-in time and reconfirmation policies may differ. We suggest you check with your airline for the latest information.
    Electronic Tickets: When travelling on an electronic ticket it is a requirement that you carry your passport at all times for international travel. It is essential that the name on your ticket matches exactly the name as shown on your passport. For domestic travel you must carry some form of photographic identification such as a driver's licence.
    Seating & Meals: Pre-assigned seating and special meal requests as shown on your itinerary are subject to confirmation upon check-in and the airlines reserve the right to change this without notice at any time.
    Baggage & Quarantine: International safety measures are place to protect travellers. Please refer to respective airline/country policies for further information on restricted baggage and quarantine items or baggage allowance.
    Taxes & Pricing: All pricing and costs quoted are subject to change without notice due to airline/operator increases and/or currency fluctuations. Prices can only be guaranteed when paid in full and tickets and documents have been issued. Many countries have a departure tax which is additional to the price of your ticket. Please ensure you have sufficient local currency to pay for this at the airport.
    Itinerary: To view your itinerary and/or electronic ticket on the internet, log on to www.virtuallythere.com. To access your booking you will need your Booking Reference which is detailed on your American Express booking confirmation.
    No Show / Cancellation Penalties: You may incur an airline no-show fee if you fail to notify the airline or Membership Rewards Travel that you are unable to travel on the flights you have booked. Additionally failure to cancel the flight reservation may deem your ticket unusable and non refundable. Certain categories of fares have penalties applicable if cancelled within the stipulated time. If not cancelled within these time-frames, the ticket is deemed No Show. No show / cancellation penalties also apply to hotels / car rentals. Generally, hotels / car rentals need to be cancelled at least 48 hours prior to check-in. Please check with hotels / car rental for more information.
  19. Passport: Please ensure you hold a passport that has at least 6 months validity beyond the last day of the ensuing trip.
  20. Visas: Please ensure you have any applicable visas for the countries you are visiting or transiting. It is your responsibility to obtain correct visa documentation.
  21. Home Contact: It is essential that we have your correct home and mobile telephone numbers on file so that you can be contacted in the event of flight rescheduling or cancellations. We recommend that you contact the airline to check the flight is departing on schedule as there may be limited opportunity to contact each traveller to advise of flight delays.
  22. Vaccinations: Some countries have health and vaccination requirements. Travellers who do not have appropriate documentation for the required vaccinations may be subjected to a medical check-up, isolation, or quarantine or a combination of all these for up to 6 days or more. We recommend you contact your doctor or a local vaccination clinic who are experts in this area. Alternatively you can go on-line to http://www.cdc.gov for further information.
  23. All Non-US Passport Holders Travelling to USA: The US Customs and Border Protection Agency will require additional details from all Non-US Passport Holders travelling to the United States. Travellers must provide passport and details of where they are staying in the US prior to departure at airport check-in. Please ensure you allow additional time at check-in to avoid anticipated delays.
  24. All travellers to the USA: Please note that your airlines may be required by laws in the USA and other countries to give border control agencies access to passenger data. Accordingly any information they hold about you and your travel arrangement may be disclosed to the customs and immigration authorities of any country in your itinerary. Due to the complexity of US requirements travellers are encouraged to check the following website to ensure they qualify under the USA Visa Waiver Program.
  25. US Border Requirement: Due to US border control changes each foreign visitor between 14 and 79 years of age will be required to have their fingerprints and photographs taken digitally upon arrival at a US port by the immigration authorities.   26. Travel Intermediary Disclosure: American Express considers various factors in identifying travel suppliers and recommending specific itineraries. In this role, we are acting as an independent third party and not as a fiduciary. We want you to be aware that certain suppliers pay us commissions as well as incentives for reaching sales targets or other goals, and from time to time may also provide incentives to our travel counsellors. Certain suppliers may also provide compensation to us for various marketing and administrative services that we perform for them, such as granting them access to our marketing channels, participating in marketing programs and supporting technology initiatives. In addition, we receive compensation from suppliers when customers use the American Express Card or other American Express products to pay for supplier products and services. From time to time we may enter into other business relationships with suppliers and these arrangements, including levels and types of compensation and incentives we receive, are subject to change. In identifying suppliers and recommending itineraries, we may consider a number of factors; including supplier availability, your preferences, and any agreements we have to book travel in accordance with your companys travel policy. The relationships we have with suppliers may also influence the suppliers we identify and the itineraries we recommend.
  27. Liability Statement: American Express acts only as agent for the airlines hotels and other contractors providing services (suppliers). By using the services on this itinerary the client agrees that neither American Express nor its related companies employees or representatives shall be liable for any loss costs expense injury accident or damage to person or property resulting directly or indirectly from (a) the acts or omissions of such suppliers (b) acts of God or (c) any other cause beyond American Express control.

    The Transportation Security Administration requires us to collect information from you for purposes of watch list matching, under the authority of 49 U.S.C. section 114, and the Intelligence Reform and Terrorism Prevention Act of 2004. Providing this information is voluntary; however, if it is not provided, you may be subject to additional screening or denied transport or authorization to enter a sterile area. TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice.   29. Membership Rewards Travel: Membership Rewards and airline ticket terms and conditions apply. All Membership Rewards Travel redemptions are subject to specific fare classes and airline availability. Membership Rewards Travel tickets are non-refundable and non-transferable. Only available for fares offered through the Sabre Global Distribution System. Changes are permitted subject to the terms and conditions set out by the applicable airline and fare type ticketed. Changes are subject to the airlines applicable fee per ticket and an additional Membership Rewards Travel amendment fee of NZD50.00 per ticket. Points may not be redeemed for Membership Rewards Travel tickets for resale, promotional or commercial purposes.
