Welcome to the Amex skill for Amazon Alexa brought to you by American Express® (the “Amex skill”)!
What is it? The Amex skill is a voice-driven capability that enables you to access certain information about eligible Cards linked to your American Express® online account (“Amex account”) on devices that connect to the Alexa Voice Service (“Alexa”), like the Amazon Echo, Amazon Echo Show, Amazon Tap and Amazon Fire TV (“Connected Devices”). Once you’ve enabled the Amex skill, you can ask Alexa to check your account balance, make a payment, get available Amex Offers,
review your recent charges, check when your payment is due, check available credit, check your Membership Rewards® balance, and more by simply using your voice. When you make a request to the Amex skill (a “User Request”), you will receive a voice response from the Amex skill (an “Amex Response”), a record of the voice interaction (an “Alexa Card”) may appear in the Alexa app (the “Alexa App”), and if you are utilizing an Amazon Echo Show, a separate record of the voice interaction may appear on the device display (the "Alexa Display"). The Amex skill is not set up to respond to customer service requests, and the skill has limited ability to respond to any free-form audio messages at this time. Please do not send us messages through Alexa unless the message is an audio command that the Amex skill is programmed to recognize. The Amex skill is also not intended to be used to dispute a charge on your Card (as defined below) account.

IMPORTANT TERMS, CONDITIONS & DISCLOSURES
The following terms and conditions of use (these “Terms of Use”) govern your access to and use of the Amex skill. These Terms of Use are a binding legal agreement between you and American Express Travel Related Services Company, Inc. (“we,” “us” or “Amex”). They apply to you and anyone else you authorize to use the Amex skill with your Linked Account (as defined below).
PLEASE CAREFULLY REVIEW THESE TERMS OF USE BEFORE LINKING YOUR AMEX ACCOUNT OR USING THE AMEX SKILL. YOUR CONTINUED USE OF THE AMEX SKILL, OR THE ONGOING CONNECTION OF YOUR LINKED ACCOUNT, CONFIRMS YOUR ONGOING ACCEPTANCE OF THE LAST MODIFIED VERSION OF THESE TERMS OF USE. IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MUST DISCONTINUE YOUR USE OF THE AMEX SKILL AND IMMEDIATELY DISABLE THE AMEX SKILL TO UNLINK YOUR AMEX ACCOUNT. Eligibility

The Amex skill is available for American Express Card Members (“Card Members”) who have a valid American Express User ID and Password that provide Amex account access for one or more eligible Card(s). An “eligible Card” is any valid American Express U.S. Consumer or Small Business credit or charge card not cancelled and issued to you by a U.S. banking subsidiary of American Express. Prepaid products, Corporate Cards and American Express-branded cards or account numbers issued by other financial institutions are not eligible. Don’t have an American Express User ID and Password? - You represent that you have the power, authority and capacity to accept these Terms of Use.
- The Amex skill is intended for individual Card Members who are at least eighteen (18) years of age or older. To the extent you are not a person in whose name an eligible Card account is opened (a “Basic Card Member”) but you are an additional Card Member who is still a minor under the laws of the jurisdiction in which you enter into these Terms of Use (under 18 years of age in most States), you must have obtained the prior consent of your Basic Card Member to link your eligible Card(s) to the Amex skill. By linking to or using the Amex skill, you certify, acknowledge and agree that: (1) you have received your Basic Card Member’s consent in advance of such linking or use; and (2) your continued use is based upon continued consent from your Basic Card Member.

Linking your Account

To enable the Amex skill, open the Alexa App on your Personal Device (as defined below), search for “Amex” under “Skills” in the menu, then select “ENABLE.” As a condition to enabling the Amex skill, you will be prompted to link your Amex account to the Amex skill. An Amex-hosted log-in page will appear through the Alexa App, and you will be prompted to log in to your Amex account by using your American Express User ID and Password. You will also be prompted to create a 4-digit PIN (an “Alexa PIN”). You will be asked to provide the Alexa PIN through a voice command each time you choose to open the Amex skill. Providing the Alexa PIN will begin an authenticated session for your use. If you do not interact with the Amex skill for a duration of five (5) minutes, your authenticated session will expire and you will be prompted to provide your Alexa PIN again for security purposes in order to interact with the Amex skill. If you do not remember your Alexa PIN, you should disable the Amex skill and then re-link your Amex account in accordance with this “Linking Your Account” section. If you say your Alexa PIN incorrectly more than five (5) times, your Amex account will be unlinked from the Amex skill. To relink your Amex account to the Amex skill, you will need to disable the Amex skill within the Alexa App and then re-enable the Amex skill and link it to your Amex account in accordance with this “Linking Your Account” section.
- Once you have linked your Amex account to the Amex skill, all of your eligible Cards linked to your Amex account will be linked to the Amex skill at the same time (such Cards, “Linked Cards” and such account, the “Linked Account”). You will not have the option to link less than all of these eligible Cards.
- Please note that the Amex-hosted log-in page is visible only to you, unless you expose your Personal Device viewing screen to others or otherwise share this page. Your American Express User ID and Password and your Alexa PIN are not visible to or shared with Amazon.

You can unlink your Linked Account from the Amex skill at any time. See “Unlinking Your Linked Account” below for a description on how to do so.

Certain Authorizations
- When you have linked your Amex account to the Amex skill and set the PIN, you will be able to start engaging with the Amex skill.
- When you choose to make a bill payment using the Amex skill, you authorize us to enable and process such payment in accordance with our standard processes and procedures, including, without limitation, drawing funds from the bank account(s) associated with bill payment in your Linked Account.
- Information you receive relating to purchases you make with your Linked Card(s) may reflect pending charges. Pending charges have been temporarily authorized to be charged but are not yet finally posted against your applicable Linked Card. Some of these pending charges may include amounts which are pre-authorized by a merchant before you actually make a purchase (such as a hotel check-in) and are submitted to us as a final charge later when the transaction is completed (like at hotel check-out). In these instances, the pending charge you will hear and see when you engage with the Amex skill will be the pre-authorized amount, not the final charge. A maximum of nine (9) total charges made during the preceding two-month period with each Linked Card, whether pending and/or posted, will be accessible to you through the Amex skill.

To see the final charge posted against any of your Linked Card(s), go to your Billing Statement. For a copy of your Billing Statement or other account details, please log in to your Amex account at
www.americanexpress.com.
- Account information you receive from the Amex Skill does not replace or act as your Billing Statement. In the event there are any inconsistencies between such information and your Billing Statement, your Billing Statement governs and reflects the appropriate charges due.

Unlinking Your Linked Account
- You can unlink your Linked Account by disabling the Amex skill. To disable the Amex skill, open the Alexa app on your Personal Device, search for “Amex” under “Skills” in the menu, then select “DISABLE SKILL."
- You cannot unlink a single Linked Card.

Privacy and Data UseData Collection

When you link your Amex account to the Amex skill and set the Alexa PIN, Amazon may collect and use certain data you provide to the Amex skill for the purpose of servicing you in accordance with
Amazon’s Privacy Notice
and the
Alexa Terms of Use. Amex may also collect and use certain data you provide to the Amex skill in accordance with the Amex Online Privacy Statement.

Amazon may periodically collect and use technical data and related information, including, but not limited to, technical data about your interactions with the Amex skill (collectively, “Technical Data”) in accordance with
Amazon’s Privacy Notice
and the
Alexa Terms of Use. Amex may also periodically collect and use Technical Data to facilitate updates to our services. Technical Data will not personally identify you and Amex may use it to improve our products or to provide services or technologies to you.
- Amazon will retain voice recordings of your interactions with the Amex skill. To delete voice recordings, go to “Settings” and follow the instructions.
- Please note that Amazon will not retain a voice recording of your Alexa PIN.
- As noted earlier, your American Express User ID and Password are not visible to or shared with Amazon.

Data Sharing and Usage
- Amex will share Amex Responses, Alexa Cards and Alexa Displays with Amazon only for the purpose of responding to your User Requests.

This information may include the last 5 digits of your Linked Card(s), balance on Linked Card accounts, possible amounts you can pay on your bill, Amex Offer details, most recent charges, the name of your bank institution, last 4 digits of your bank institution account, available credit, Membership Rewards balance, and amount saved through offers. Such information will remain subject to the
Amex Online Privacy Statement, and Amazon may only use such information to service you.
- Amex may use the billing address that we already have on file for you in order to support location-based services that you may request from the Amex skill, such as more relevant Simple Card timestamps. Amex will use your billing address in accordance with the Amex Online Privacy Statement.

Your User Requests, such as “check my balance,” “make a payment,” “statement balance,” “total balance,” and “payment due,” will remain subject to the
Amex Online Privacy Statement, and Amazon may only use such information to service you and to enhance their voice services and capabilities.

Amazon may de-identify your User Requests, which will not identify you as an individual or as an Amex Card Member, and use them in accordance with
Amazon’s Privacy Notice
and
Alexa Terms of Use.

Security
- It is solely your responsibility to maintain the physical security of your Connected Devices and the personal devices you use to access the Alexa App (for example, your mobile phone, tablet, and/or laptop) (“Personal Devices”) and the confidentiality of the information and services accessible through Connected Devices, Personal Devices and the Alexa App.
- You should keep your Connected Devices, your Personal Devices, your American Express User ID and Password, your Amazon user ID and password, your Alexa PIN and other credentials secure in the same manner as you would keep secure your cash, checks, credit cards, and other personal identification numbers and passwords that you wish to keep private and confidential.
- Anyone with whom you share your Connected Devices, your Personal Devices, your American Express User ID and Password, your Amazon user ID and password, and/or Alexa PIN will be able to use the Amex skill and/or the Alexa App and have access to information and services to which you have access via Alexa. Any such individual shall be deemed an authorized user who is using Amazon, Alexa and/or the Amex skill (as the case may be) with your consent. We recommend that you not share such credentials with anyone whom you would not wish to have access to your private information, your Linked Account or any Linked Card. Take care to ensure that no one overhears your private information, including your Alexa PIN, as you interact with the Amex skill. Remember that you must unlink your Linked Account and delete your history under “Settings” in the Alexa App prior to sharing or transferring your Personal Devices or giving access to your Amazon account or Connected Devices to another.
- We recommend that you always use available security and lock features on your Personal Devices. If you do not utilize the lock screen feature of your Personal Devices or log out of the Alexa App, the messages and other information contained in the Alexa App, including the Alexa Cards, will be accessible to anyone with access to your Personal Devices.
- Please note that all information on your Alexa Display will be accessible to anyone who can see your Echo Show. However, such information will only be displayed for up to 30 seconds.

Do not include any sensitive personal information (e.g., your Linked Card number(s), Social Security Number, date of birth, Alexa PIN, etc.) in a session with Alexa. Please note we will never ask you for, state or otherwise include, your Linked Card number(s) or other sensitive information, via Alexa or in any emails. If you receive a message that you believe could be fraudulent, please contact us immediately at
spoof@americanexpress.com.
- To avoid any unauthorized access to your personal information, particularly in the event you believe: (1) someone has gained unauthorized access to your Amazon account, a Connected Device or a Personal Device or your American Express User ID or Password, Amazon user ID or password or Alexa PIN; or (2) your device or credentials have been or may be lost, stolen or otherwise compromised in any way, you should immediately:
- disable the Amex skill;
- change your compromised credentials, and
- notify the party issuing your compromised credentials (in the case of Amex, call the number on the back of your Linked Card(s)).
- You agree to notify us immediately if you suspect fraudulent or abusive activity relating to your Linked Account or Linked Card(s).
- Your Cardmember Agreement
- Your Cardmember Agreement governs all use of your Linked Card(s), and these Terms of Use do not in any way amend, modify, supersede, change or replace your Cardmember Agreement or any other notice or information that you may from time to time receive in connection with your Linked Card(s). Your Cardmember Agreement also contains a Claims Resolution provision, which includes a provision regarding binding arbitration that affects your rights with respect to the use of your Linked Card(s). That arbitration provision applies as well to any disputes between you and us arising from these Terms of Use or your use of the Amex skill.
- You can call the Amex number on the back of your Linked Card(s) to request a copy of the applicable Card Member Agreement(s).
- Third Party Agreements
- Amazon, your mobile operating system provider, and other third party services or sites incorporated in Amazon or linked to or through the Amex skill, have their own terms and conditions and privacy policies and practices (collectively, “Third Party Agreements”). You may be subject to these Third Party Agreements when you use the Amex skill, give these third parties your personal information, or otherwise use their services (e.g. if you decide to add your Linked Card number and billing information to your Amazon account for purchases) or visit their respective mobile platforms or websites. It is your responsibility to review and accept all applicable Third Party Agreements before using the Amex skill.
- Amex is not responsible for the security, accuracy, legality, appropriateness or any other aspect of the content or functionality of Amazon, Alexa, any device or any third party’s products or services (whether or not related) that may be incorporated or linkable from the Amex skill.
- We are not responsible for, and do not provide, any support or assistance for any third party hardware, software or other products or services. If you have any questions or issues with a third party product or service, including issues pertaining to the operation of your supported iOS or Android device, please contact the appropriate third party in accordance with its procedures for customer support. If you have any questions or issues pertaining to Alexa (other than questions or issues specific to the use of the Amex skill), please contact Amazon.
- While Amex does not currently charge a fee for your use of the Amex skill, you will be responsible for all fees that may be imposed by non-Amex parties in connection with such use (such as data usage charges) and subject to any restrictions those third parties may impose.

Changes to Terms of Use

We reserve the right to revise these Terms of Use at any time, and you are deemed to be aware of and bound by such changes by your continued access to or use of the Amex skill. We will indicate that changes to these Terms of Use have been made by updating the date indicated after "Last Modified:" at the beginning of these Terms of Use. If you do not accept any such changes, you acknowledge and agree that your sole and exclusive remedy is to discontinue your use of the Amex skill. See “Unlinking Your Linked Account” for details on how to discontinue your use.
- Termination
- We may suspend, limit, interrupt, restrict, discontinue or terminate any and all aspects of the Amex skill and your access to the Amex skill in our sole discretion, for any reason, and without notice or liability to you or any third party.
- Any terms of these Terms of Use which by their nature should survive any termination of these Terms of Use will so survive.
- Miscellaneous
- Communications. You agree that we may communicate with you about matters related to the Amex skill and your use of same through the use of our website or the email address you have on file for your Linked Account. We may always, in our sole discretion, also provide you with any such communications on paper, even if you have authorized or requested electronic delivery.
- Applicable Laws. Your access to and use of the Amex skill are subject to applicable international, federal, state and local laws and regulations. We reserve the right to seek all remedies available at law and in equity for violations of these Terms of Use.
- ANY ATTEMPT BY AN INDIVIDUAL OR ENTITY TO DELIBERATELY INTERFERE, INTERRUPT, MODIFY, AUDIT, ASSESS, RE-ENGINEER, DILUTE, TARNISH, OR DAMAGE ANY ASPECT OF THE AMEX SKILL OR UNDERMINE THE LEGITIMATE OPERATION OF THE AMEX SKILL IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND WE RESERVE THE RIGHT TO SEEK DAMAGES, INJUNCTIONS, AND COSTS (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) TO THE FULLEST EXTENT PERMITTED BY LAW.
- Severability. If any part of these Terms of Use is determined to be invalid or unenforceable pursuant to applicable law, then such invalid or unenforceable provision will be deemed superseded by a valid and enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms of Use shall continue in full force and effect.
- No Waiver. Our failure in any instance to exercise or enforce any provision of these Terms of Use shall not constitute a waiver of such provision or any other provision.
- Third Party Beneficiaries. These Terms of Use shall inure to the benefit of and be binding upon the parties hereto and their successors and assigns.
- Entire Agreement. These Terms of Use and your Cardmember Agreement set forth the entire understanding and agreement between you and us, whether written or oral, with respect to the subject matter hereof and supersede any prior or contemporaneous understandings or agreements with respect to such subject matter.
