Chat with American Express® in the iOS Messages app (the “Amex Service”)!

 

What is it? The Amex Service is a service that enables you to send and receive messages relating to your eligible U.S. Card (“Card”) in Apple’s iOS Messages app (the “Messages App”) through Apple’s Business Chat Service (“BCS”). These messages will show up in your Messages App (and as push notifications, if enabled) on all devices connected to your iCloud account.

 

The Amex Service is set up to automatically respond to certain types of questions. If the Amex Service is not able to answer your question, it will ask you to verify your account on an iPhone or iPad to chat with an American Express Customer Care Professional (a “Customer Care Professional”). If you do not wish to chat in BCS with a Customer Care Professional, you can contact us at www.americanexpress.com/contactus or call the number on the back of your Card.

 

IMPORTANT TERMS, CONDITIONS & DISCLOSURES  

The following terms and conditions of use (these “Terms”) govern your access to and use of the Amex Service. These Terms are a binding legal agreement between you and American Express Travel Related Services Company, Inc. (“we” or “Amex”). They apply to you and anyone else you authorize to use the Amex Service with your Card on your behalf. 

 

PLEASE CAREFULLY REVIEW THESE TERMS BEFORE USING THE AMEX SERVICE. YOUR CONTINUED USE OF THE AMEX SERVICE CONFIRMS YOUR ONGOING ACCEPTANCE OF THE LAST MODIFIED VERSION OF THESE TERMS THAT CAN BE VIEWED AT www.americanexpress.com/us/customer-service/digital/chat/ios-messages-app/terms. IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS, YOU MUST DISCONTINUE USE OF THE AMEX SERVICE.

 

  • Eligibility    
    • The Amex Service is available for American Express Card Members (“Card Members”) with an eligible Card and an iOS device. An “eligible Card” is any American Express U.S.  credit or charge card 1) not cancelled and 2) issued to you by a U.S. banking subsidiary of American Express. 
    • You must also have a valid American Express User ID and Password that provides online account access for your eligible Card.      
    • You must have the latest version of the Amex Mobile® app downloaded on your iPhone or iPad and have updated your iOS device to iOS 11.3 or higher.
    • You represent that you have the power, authority and capacity to accept these Terms.       
    • The Amex Service is intended for individual Card Members who are at least 18 years or older. To the extent you are an additional Card Member but still a minor under the laws of the jurisdiction in which you accept these Terms (under 18 in most States), you must have obtained the consent of your Basic Card Member to use the Amex Service. By using the Amex Service, you certify and agree you have received that consent.
  • Authorization to Receive Messages.  By using the Amex Service, you authorize us to send through the Amex Service messages to you on iPhones or iPads connected to your iCloud account.
  • Privacy and Data Usage
    • Data Collection and Use
      • When you use the Amex Service, Amex will collect an Apple-generated unique identifier, which is used to identify you when you interact with the Amex Service. 
      • Amex collects and uses data sent through the Amex Service in accordance with the Amex Online Privacy Statement
      • Amex periodically collects and uses technical data and related information including, but not limited to, technical data about your interactions with the Amex Service (collectively, “Technical Data”) to facilitate updates to our services. This Technical Data will not personally identify you, and Amex may use it to improve our products or to provide you with services or technologies.  
      • Apple may collect and use data in accordance with Apple’s privacy and security policies and practices.
      • At times, we may ask you to verify your Amex account in BCS on an iPhone or iPad using your American Express User ID and Password. Your American Express User ID and Password are not visible to or shared with Apple.
  • Security
    • It is solely your responsibility to maintain the physical security of your devices and the confidentiality of the information on your devices, including in BCS and with the Amex Service.
    • You should keep your devices, your American Express User ID and Password, and other credentials secure in the same manner as you would keep secure your cash, checks, credit cards, and other personal identification numbers and passwords.
    • Anyone with whom you share your devices and/or credentials will be able to see any messages included in your Amex Service. To the extent you wish to prevent this from happening, you must delete your conversation in the Amex Service on each device connected to your iCloud account prior to sharing or transferring your device or giving anyone else access to your account.
    • We recommend you always use available security and lock features on your devices. If you do not utilize the lock screen feature of your devices, the messages and other information contained in your Amex Service will be accessible to anyone with access to your devices.
    • If Touch ID is enabled on your device(s), we caution you against storing the fingerprints of others on your device(s). If you do, please make sure the individuals who have fingerprints stored on your device(s) are authorized to access information about your American Express account in the Amex Service.
    • Please note that push notifications can be displayed on a locked or inactive device screen and within the notification tray at the top of the home screen of some devices. Since it is possible to view this information even when your devices are locked, we strongly encourage you to maintain physical control over your devices and/or turn off push notifications if you are uncomfortable with this possibility.
    • Do not include any sensitive personal information (e.g., your Card number, Social Security Number, etc.) in your messages. You should only share other personal information if prompted by a Customer Care Professional. We will never ask you for or include your Card number or other sensitive information in BCS. If you receive a Message you believe could be fraudulent, please contact us at spoof@americanexpress.com.
    • To avoid any unauthorized access to your personal information, particularly if you believe: (1) someone has unauthorized access to a device you use to access BCS or your Amex credentials; or (2) your device or other credentials have been or may be lost, stolen or otherwise compromised in any way, you should immediately: change your compromised credentials; delete your conversations with the Amex Service in BCS; and notify the party issuing your impacted credentials (if Amex, call the number on the back of your Card).
    • You agree to immediately notify us if you suspect fraudulent or abusive activity on your Card account.
  • Your Cardmember Agreement
    • Your Cardmember Agreement governs all use of your Card and these Terms do not in any way amend, supersede, change or replace your Cardmember Agreement or any other notice or information you may receive in connection with your Card account. Your Cardmember Agreement contains a Claims Resolution provision, with a provision regarding binding arbitration that affects your rights with respect to the use of your Card. That arbitration provision applies as well to any disputes between you and us arising from these Terms and/or your use of the Amex Service. You can call the Amex number on the back of your Card to request a copy of the applicable Card Member Agreement.
  • Third Party Agreements
    • Apple, your mobile operating system provider and other third party services or sites incorporated in or accessible through BCS or linked to or through the Amex Service have their own terms and conditions and privacy and security policies and practices (collectively, “Third Party Agreements”). You may be subject to these Third Party Agreements when you use the Amex Service in BCS, give these third parties personal information, or otherwise use their services or visit their respective mobile or websites. It is your responsibility to review and accept all applicable Third Party Agreements before using the Amex Service.
    • Amex is not responsible for the security, accuracy, legality, appropriateness or any other aspect of the content or function of Apple, BCS, your device or any third party’s products or services that may be incorporated or linkable from the Amex Service. We are not responsible for, and do not provide any support or assistance for, any third party hardware, software or other products or services. If you have any questions or issues with a third party product or service, please contact the appropriate third party in accordance with its procedures for customer support. If you have any questions or issues pertaining to BCS generally, please contact Apple.
    • While Amex does not currently charge a fee for your use of the Amex Service, you will be responsible for all fees that may be imposed by non-Amex parties in connection with such use (such as data usage charges imposed on you by your wireless carrier) and subject to any restrictions those third parties may impose.
  • Changes to Terms
    • We reserve the right to revise these Terms at any time. We will indicate that changes to these Terms have been made by updating the date indicated after "Last Modified:" at the beginning of these Terms. If you do not accept any such changes, your sole and exclusive remedy is to cease your use of the Amex Service.   • Termination
    • We may suspend, disable, limit, interrupt, restrict, discontinue or terminate any and/or all aspects of the Amex Service and your access thereof in our sole discretion, for any reason, and without notice or liability to you or any third party. All provisions of these Terms which by their nature are intended to survive the expiration, termination or suspension of the Amex Service or these Terms shall so survive.  
  • Miscellaneous
    • Communications. You agree we may communicate with you about matters related to the Amex Service through the use of our website or the email address you have on file for your Card.
    • Applicable Laws. Your access to and use of the Amex Service are subject to applicable international, federal, state and local laws and regulations. We reserve the right to seek all remedies available at law and in equity for violations of these Terms.
    • ANY ATTEMPT BY AN INDIVIDUAL OR ENTITY TO DELIBERATELY INTERFERE, INTERRUPT, MODIFY, AUDIT, ASSESS, RE-ENGINEER, OR DAMAGE ANY ASPECT OF THE AMEX SERVICE OR UNDERMINE THE LEGITIMATE OPERATION OF THE AMEX SERVICE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND WE RESERVE THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) TO THE FULLEST EXTENT PERMITTED BY LAW.
    • Severability. If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid and enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms shall continue in effect.
    • No Waiver. Our failure to exercise or enforce any provision of these Terms shall not constitute a waiver of such provision.
    • Third Party Beneficiaries. These Terms shall inure to the benefit of and be binding upon the parties hereto and their successors and assigns. 
    • Entire Agreement. These Terms and your Cardmember Agreement set forth the entire understanding and agreement between you and us, whether written or oral, with respect to the subject matter hereof and supersede any prior or contemporaneous understandings or agreements with respect to such subject matter.
