American Express Site Terms and Conditions

American Express, including its subsidiaries and affiliates (“American Express”), requires all users of its Internet sites on the Internet that reference American Express-branded products or services (the “Site”) to adhere to the following policies. Using the Site means that the user agrees with the terms of this Regulation.

1. Ownership of the site

The site is owned and operated by American Express.

2. Regulatory framework

User access to and use of the Site is governed by all applicable international, federal, state and local laws and regulations.

3. Copyright / Trademarks

The trademarks, trade names, and service marks (hereinafter the “Marks”) contained on the Site are the property of American Express or others. Users are prohibited from using the Marks in any way, including as meta tags on other pages and sites of the global Internet, without the written permission of American Express or third parties that own the respective Marks. All information and other materials, including software, contained on the Site or provided with their help (hereinafter - "Materials") are protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, demonstrating, publishing, selling and otherwise using the Materials contained on the Site or provided with their help,

4.Hyperlinks

 SITES allows the use of other Internet site by ending the use of sites with subsequent access to third party content or by using any third party content that is hosted on the sites themselves through technology RETURN hyperlinks and frames (hereinafter - the "external internet sites"). AMERICAN EXPRESS DOES NOT HAVE AUTHORITY TO CHANGE, UPDATE OR CONTROL THE CONTENT OF THE EXTERNAL INTERNET SITES. THE PROVISION OF A LINK TO THE INTERNET SITE DOES NOT INDICATE SUPPORT, ENDORSEMENT, FINANCING OR ANY OTHER CONNECTION BETWEEN AMERICAN EXPRESS AND THE CORRESPONDING WEB SITE AND EFFORTS. CONSIDERING THAT RECEIVING, USING AND MAKING DECISIONS BASED ON THE INFORMATION POSTED ON THE INTERNET ARE ASSOCIATED WITH CERTAIN RISKS,

American Express prohibits caching, unauthorized hypertext links to the Site, and framing of any Content available through the Site. American Express reserves the right to block unauthorized links or frames from working and American Express expressly disclaims any responsibility for Content available on any other Internet site linked to the Site other than its own. Access to any other Internet sites linked to the Site is at the user's own risk and peril.

The user should be aware that the Linked Sites may contain rules and regulations, privacy clauses, confidentiality clauses, personal data transfer clauses, and other clauses that differ from the clauses provided on the Site. American Express is not responsible for such provisions and expressly disclaims any liability arising from such provisions.

5. Disclaimer of Warranties

 All Content, products and services on the Site, or obtained from the website to which the Site is linked (the "Linked Site") are provided ON an "AS IS" BASIS, without warranty of any kind, either express or implied, including, without limitation, implied warranties merchantability, suitability for specific purposes, law, non-infringement, safety or correctness.

Except as required by applicable law, under no circumstances will American Express be liable in any way for damage or loss arising out of the user's use of information obtained through the Site or Linked Site, or the user's trust in any product or service obtained through the Linked Site. ... It is the user's responsibility to evaluate the accuracy, completeness or usefulness of any opinion, advice or other content available through the Site or obtained through the Linked Site. Please seek professional advice, if necessary, regarding the evaluation of any individual opinion, message, product, service or other content.

6. Limitation of liability for the use of the site

American Express disclaims any liability (whether by contract, tort or otherwise) for any direct, indirect, incidental, consequential, or actual damages arising from use of or in any way related to access to or use of the Site, ( even if American Express® has been advised in advance of the possibility of such damages), including liability associated with any viruses that may infect the user's computer equipment.

7. Confidentiality of user information

 Except where disclosure is required by law, American Express is committed to maintaining the confidentiality of all personally identifiable communications from a user that are sent directly to American Express. Messages posted by the user on any forum or chat are not protected as confidential. In addition, American Express may, without liability of any kind or nature, use and transfer the information contained in any such communication (including any ideas, concepts, know-how, and other intellectual property) to third parties, including, but not limited to, its parent company, subsidiaries and affiliates or American Express, for any purpose and at the discretion of American Express, in accordance with applicable law.

8. Messages

American Express is under no obligation to review any messages, information or content ("Posts") posted on the Site by users, and assumes no responsibility or liability in connection with any such Posts. Notwithstanding the foregoing, American Express may monitor Messages on the Site from time to time and may refuse to accept and / or remove any Messages containing:

a. Any illegal, harmful, threatening, offensive, defamatory, vulgar, obscene, hateful, racial, ethnic or otherwise, material of any kind, including, but not limited to, any material that encourages behavior that would constitute a criminal offense , result in civil liability or otherwise violate any applicable local, regional, national or international law.

b. Advertising or solicitation of any kind.

c. Messages sent by users on behalf of others.

d. Personal information, such as messages containing phone numbers, social security numbers, account numbers, addresses, or employers.

e. Communications by non-spokespersons for American Express claiming to speak on behalf of American Express and containing confidential information about American Express.

f. Posts offering unauthorized downloads of any copyrighted or confidential information.

g. Multiple messages posted to personal folders by the same user, repeating the same statement.

h. "Letters of happiness" of any kind

9. Transfer of personal data

The user acknowledges and agrees that by providing American Express with any personal or proprietary information of the user through the Site, the user agrees to the transfer of such personal or proprietary information of the user across international borders as necessary for processing in accordance with standard American Express business practices.

The user should be aware that the Linked Sites may contain provisions on the transfer of personal data that differ from the provisions provided in this document. American Express is not responsible for such provisions and expressly disclaims any liability arising from such provisions.

10. Changes to rules and regulations

American Express reserves the right to change this Policy at any time and users are deemed to have been informed of any changes to these Terms and Conditions.

11. Violations of rules and regulations

American Express reserves the right to use all measures available under the law and in the right of fairness in case of violation of these rules and regulations, including the right to block access from a specific Internet address to the Site.

12. Access to protected sections and sections with a password protected

Only authorized users have the right to access and use password-protected and / or otherwise protected areas of the Site. For an attempt to unauthorized access to such sections of the Site, the guilty person may be held liable.

13. Applicable law and jurisdiction

 Users of this Site agree to be bound by the laws of the jurisdiction of the English courts and are governed by English law and the Site and services are governed by English law.
