Program Terms of Service

American Express is pleased to offer a service that provides a convenient way for American Express® Card Members to add eligible American Express® Cards (“Cards”) on file as payment options with selected merchant partners (“Partners”; such service, the “Service”). Your Card Member Agreement for the Card and these Program Terms of Service (“Terms of Service”) apply to your use of the Service.

1. Privacy and Use of Information

 

a. Privacy.

Protecting your privacy is very important to us. Please review the American Express Online Privacy Statement and this provision for more information regarding the terms that apply to your privacy and disclosure of your information in connection with your use of the Service.

 

b. Use of Card Data.

By enrolling in the Service, you authorize and direct American Express to provide your Card data, including your account number and information about any associated rewards program accounts (if eligible), to the Partners you select, who will add it on file as a payment option on their sites. Your Card will not be charged until you initiate, complete, and confirm a purchase on a Partner’s site.

 

c. Partners’ Use of Your Information.

A Partner’s use of your Card data is subject to such Partner’s privacy policy and terms and conditions. You should review such materials and make appropriate choices from among those offered by a Partner. You acknowledge that American Express has no control over the privacy and data security practices of Partners (some of which may have practices that vary from our practices).

 

2. Shared Devices & Authorized Access

It is your responsibility to maintain the confidentiality of your login information and the security of any personal and public devices you may use to access the Service or Partner sites. For example, anyone who has access to your login credentials for a Partner site or to a fingerprint registered to your device may be able to log into your American Express online account and use the Service.

 

3. Restricted Activities

You represent that you are authorized to access and use the Card account credentials that you are using to access the Service. You also agree that in connection with your use of the Service, you will not:

  • Breach these Terms of Service, interfere with or disrupt the Service, or violate any requirements, procedures, policies or regulations of networks associated with the Service;
  • Violate any applicable law, provide false, inaccurate, or misleading information, or engage in fraudulent, deceptive or unfair activity;
  • Use any robot, spider, other automatic device, or manual process to monitor or copy the Service;
  • Tamper with another user’s data or use of the Service, impersonate any person or entity, or falsely state or otherwise misrepresent your identity; and
  • Disrupt the normal flow of information or otherwise act in a manner that negatively affects other users’ ability to use the Service.

4. Suspension or Termination of the Service; Revisions to these Terms of Service

American Express may suspend, discontinue, disable or terminate the Service and your access to the Service, without prior notice to you and in our sole and absolute discretion. American Express may also revise these Terms of Service at any time.  We will update the effective date above when we do so.

 

5. Disclaimer of Warranties

YOU EXPRESSLY ACKNOWLEDGE THAT THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND  AMERICAN EXPRESS DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF SATISFACTORY QUALITY, FUNCTIONING AND ACCURACY OF THE SERVICE.  AMERICAN EXPRESS FURTHER DISCLAIMS ALL WARRANTIES REGARDING PERFORMANCE OF THE SERVICE AND DOES NOT WARRANT OR GUARANTEE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO THE SERVICE. AMERICAN EXPRESS DOES NOT OPERATE OR CONTROL THE WIRELESS NETWORK USED TO ACCESS THE SERVICE AND SPECIFICALLY DISCLAIMS ANY WARRANTIES IN CONNECTION WITH THE PRIVACY OR SECURITY OF YOUR WIRELESS DATA TRANSMISSION, WHICH IS GENERALLY PRE-CONFIGURED BY YOUR WIRELESS INTERNET SERVICE PROVIDER.  YOU UNDERSTAND AND AGREE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE, INCLUDING DAMAGE TO YOUR COMPUTER SYSTEMS OR DEVICES, OR LOSS OF DATA, THAT RESULTS FROM YOUR ACCESS TO OR USE OF THE SERVICE. 

 

6. Governing Law

These Terms of Service are construed in accordance with the applicable Card Member Agreement for your Card and are governed by the law governing such Card Member Agreement.

 

7. Managing Your Card on File

There are no fees to use the Service. However, if you choose to receive a one-time access code via SMS, standard messaging fees from your mobile phone carrier may apply. If you wish to remove your Card on file with a Partner, please contact the Partner to do so.
