Regulations on Provision of Electronically Supplied Services for American Express Dutch Site ("Website Rules").

1. Terms of use

American Express Company, its subsidiaries and affiliates (‘American Express’) requires that all users of our sites on the World Wide Web (‘Site’) services, tools, or applications (‘Online Service’) adhere to the following rules and regulations. By accessing the Site you indicate your acknowledgment and acceptance of these terms and conditions.

 

If you are unable (or do not wish) to do so, we must ask you to stop using our Site and Online Service.

 

2. Laws and regulations governing access to the Online Services and the service

The user's access to and use of the Site and Online service is subject to all applicable laws and regulations, in particular Dutch law and the Act on rendering electronic services. The terms and conditions regulating the access to Online Services to the extent not regulated herein shall be specified in additional terms and conditions made available to user prior to the conclusion of an agreement for the Online Services, in particular in American Express products’ terms and conditions.

3. Technical requirements

In order to use the Site in undisturbed and correct manner you are recommended to use current version of any web browser on your device with access to the Internet and enabled cookies technology.

 

The mobile version of the Site requires a mobile device with access to the Internet.

4. Liability

American Express represents that all materials and information presented within the Online Service and Site ("Resources") are collected and edited with due diligence.

 

However, the information available within the Site and Online services should be treated as for illustrative purposes only and does not constitute any binding contract nor advice from American Express.

 

American Express shall not be liable for any decisions made by the user based on information obtained as a result of using the Resources, or for any loss or damage (including lost profits) resulting from the use of information obtained from the Online Service and Site.

 

Anything to the contrary may apply if there is an express contractual agreement between you and American Express.American Express cannot and does not guarantee the continued and uninterrupted availability of all Online Services and the Site, especially resulting from events and/or circumstances of technical difficulties beyond American Express' control.

 

American Express shall not be liable for cases of non-availability of the Online Service and Services due to failure of the telecommunications system and other consequences of malfunction of the telecommunications links and damages caused by such situation.

 

5. Linked websites

American Express is not liable for content of pages outside of the Site or Online Services, including any content of websites that can be accessed via hyperlinks or links created within the Site or Online Services. American Express is also not liable for links on third parties websites that link to the Site. Such links are not permitted without express written permission of American Express.

 

6. Copyright and trademark rights

The trademarks, logos and service marks ("Marks") displayed within the Site and Online service are the property of American Express and other parties. Users may not use the Marks for any purpose, including as metatags, on other sites or Web sites without the written permission of American Express or such third party who may own the Mark. All information and content, including any software programs available on or through the Site or Online Service (‘Content’) is protected by copyright. You may not modify, copy, distribute, send, post, perform, publish, sell, license, create derivative works from, or use any Content available on the Site or Online Service for any other purpose than authorized personal use.

 

7. Use of posting boards and chat rooms

American Express may provide posting boards and chat rooms within the Site. Users are prohibited to provide any illegal content. American Express is not liable for any postings made by users and is under no obligation to view any messages, information or content that users choose to disclose through the Site or Online services.

 

However, American Express reserves the right to monitor such content and, if it deems it appropriate, to reject or remove the content that it contains:

 

  1. Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law.
  2. Advertisements or solicitations of any kind.
  3. Messages posted by users impersonating others.
  4. Personal information such as messages which state phone numbers, social security numbers, account numbers, addresses, or employer references.
  5. Messages by non-spokesperson employees of American Express purporting to speak on behalf of American Express or containing confidential information or expressing opinions concerning American Express.
  6. Messages that offer unauthorized downloads of any copyrighted or private information.
  7. Multiple messages placed within individual folders by the same user restating the same point.
  8. Chain letters of any kind.


8. Confidentiality of user communications

Except as required by law and in accordance with the American Express Privacy Statement, American Express will maintain the confidentiality of all user communications which contain personal user information and which are transmitted directly to American Express. Postings by a user on any message board or in any chat room will not be protected as confidential and American Express may use and provide information contained in any such postings (including any ideas, concepts, know-how or other intellectual property) to any of its parent company, subsidiaries and affiliates for any purpose whatsoever and as deemed appropriate by American Express.

 

User should be aware that Linked Sites may contain confidentiality provisions that differ from the provisions provided herein. American Express is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

9. Access to password protected/secure areas

Access to and use of password protected and/or secure areas of the Sites is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Sites may be subject to prosecution.

 

You must keep your login details confidential and do not share them with any third party. Any negative consequences of non-compliance to above shall be borne solely by user.  

 

10. Transfer of personal information

All personal data provided by users through the Site and Online Services are processed with due diligence, in accordance with the principles described in American Express Data protection and privacy principles.

 

11. Use of "cookie" file features

American Express reserves the right to store data on your computer in the form of a "cookie" or similar file to customize the Site according to your preferences.

 

American Express Cookie Policy provides additional information about the use of cookies and how to disable cookies.

 

12. Violation of rules and regulations

American Express reserve the right to seek all remedies available at law violations of these Website rules, including the right to block access from a particular Internet address to the Site or Online Service.

 

13. Changes to the website rules

American Express reserves the right to change Website rules at any time without prior notice. The change is effective upon publication of the new Website rules. Please always refer to the current Website rules.

 

14. Jurisdiction and governing law

Users of American Express Netherlands site agree to submit to the laws of Dutch courts, and Site and Online service are governed by Dutch law.
