American Express honors lawfully issued subpoenas. American Express does not accept service of subpoenas at any American Express Office location. American Express companies occupy many buildings, however mailing and/or personal delivery of subpoenas to these locations risk delay and/or rejection. If you seek documents and/or information from American Express in connection with a legal matter, please direct your subpoena or any related correspondence to:

Processing Time

 

The processing time for subpoena fulfillment is approximately 30 calendar days after we are properly served with the subpoena. In certain instances, it may take more time if extensive information is requested or if requestors provide insufficient information. During high volume periods, subpoena fulfillment may take up to 60 calendar days.

 


Subpoena Requirements

 

In order to be valid, Subpoenas must:

  • Indicate the court/jurisdiction and include the case number and case style or have an Agency Letterhead
  • Be issued to the correct American Express Entity
  • Be signed and dated
  • Provide either: Customer's full SSN/EIN or Customer's full Account Number or Customer's full Name AND last 4 digits of SSN/EIN or Customer's full Name AND last 5 digits of Account Number
 

Subpoenas should also clearly identify the documents and/or records requested. Any subpoenas received with vague requests (i.e. “any and all”), including non-specific time periods, may be challenged or result in limited responses. Additionally, if a time period is not specified, then we will provide the last 6 months of available records from the date we receive the Subpoena. Only when we are satisfied that the legal process is valid and appropriate do we deliver the data required to be responsive to the request.

 


Payment/Fees

 

We require payment for our subpoena response services unless there are exceptions under state/federal law governing rates that may be charged. Generally, the charges are as follows:

  • Labor : $22.00 per hour
  • Copies : $0.30 per page
  • Checks : $5.00 per check
  • Redactions : $1.00 per page
  • Shipping: Regular – 2 Days : $15.00 minimum*
  • Shipping: Expedited – Overnight : $25.00 minimum*

*Additional charges may apply. A minimum of one (1) hour labor fee is assessed.

 

Cash is not accepted. We accept checks payable to American Express and in certain instances, payment via Electronic Funds Transfer. You will receive an invoice with the amount due. Payment is expected within 30 days. Unpaid invoices are subject to collection.

 


Additional Documentation

 

Motions to Quash or Objections must be received prior to the date on which American Express must legally comply with the subpoena in order to prevent the release of records. In such instances, the compiled records will be retained and released only upon court order, joint stipulation of the parties or with the customer's written authorization. We also reserve the right to request supporting documentation to determine how the records sought are relevant to the pending litigation or proceeding.

Retention of Documents Produced

 

In most instances, the Subpoena Response Unit does not retain a copy of the documents that are produced. In the event that you need to reorder documents, they will be available only if they fall within our applicable retention period. Exceptions may exist when there are specific American Express policies or statutes governing retention of documents.
