The following terms and conditions (these “Terms of Use”) govern your use of an eligible American Express® Card or a virtual account number associated with an eligible American Express account (each a “Card”) on the Google Pay Properties and/or using Push Provisioning (both defined below) on devices that are supported by Google. These Terms of Use are a legal agreement between you and American Express Travel Related Services Company, Inc. (“we,” “us,” or “Amex”).

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ADDING OR USING YOUR CARD IN THE GOOGLE PAY PROPERTIES OR USING PUSH PROVISIONING, BECAUSE BY DOING SO, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE TERMS OF USE

In addition to these Terms of Use, you will continue to be subject to the applicable Card Member Agreements, Rewards Checking Account Terms & Conditions (“Rewards Checking Account Terms”), Business Checking Account Agreements (including any addenda) (“BCA Agreements”) or other terms that govern your Card.

1. OVERVIEW OF THE GOOGLE PAY PROPERTIES, PUSH PROVISIONING AND THESE TERMS OF USE

The Google Pay Properties allow you to make: (i) contactless payments at contactless-enabled point-of-sale terminals or readers that accept contactless payments in the United States, its commonwealths, possessions and territories; (ii) purchases in-app or on websites of merchants participating in Google Pay (collectively with (i), the “Google Wallet”); and (iii) online purchases using an alternate Card number where available in the Google Chrome browser and in select Android apps (“Amex Virtual Card Number”, and collectively with (i) and (ii), the “Google Pay Properties”). You also have the option to save your Card to the Google Pay Properties while you are on an American Express online property (web or app) or a third-party online platform authorized by American Express (collectively, “Push Provisioning”).

Please carefully review the terms that govern using each of the Google Wallet, Amex Virtual Card Number and Push Provisioning that are provided below, in Sections 2(a), 2(b) and 2(c), respectively, and the terms further below in Sections 3 – 13, that apply to using the Google Pay Properties generally.

Google may have other functionality that they also brand as “Google Pay” but these Terms of Use do not apply to the use of any American Express Card, including any eligible Card, as a payment method for such other Google functionality that falls outside the scope of these Terms of Use even if they are also branded as “Google Pay” by Google (collectively, “Other Google Pay Properties”).

2. USE OF YOUR CARDS

a) If You Use the Google Wallet

By transacting on the Google Wallet, you are authorizing the payment for the applicable transaction with your Card in the Google Wallet. When you add your Card in the Google Wallet, Google may add that same Card on file to be an eligible payment method for use on Other Google Pay Properties. If you do not want Google to store your Card on file for use in Other Google Pay Properties, then you should go to the settings in your Google account and remove your Card.

By transacting on the Google Wallet, we share certain information with Google in order for Google to: (i) display your Google Wallet transactions and your recent transactions outside the Google Wallet using the Card that you enrolled into the Google Wallet, (ii) provide you with merchant-specific receipts and offers; and (iii) provide searchable summaries, analysis and trends within Google Wallet. Merchants also may separately provide Google with certain transaction data relating to purchases using your Card. If you do not want:

  1. Amex to share with Google your recent Card transaction data using the Google Wallet, you may delete your Card from the Google Wallet.
  2. Amex to share with Google your recent Card transaction data outside of the Google Wallet, you may opt out by going to the settings menu in the Google Wallet and turning off such sharing.

Google provides you with the option to turn transaction notifications on and off within the Google Wallet settings or your general device settings.

You may receive push notifications from the Google Wallet from time to time reflecting your Card account activity. If you do not wish to receive notifications, you may turn off these notifications within the Google Wallet app or your device notification settings.

b) If You Enroll in Amex Virtual Card Number

Enrolling in Amex Virtual Card Number

Amex Virtual Card Number enables you to replace your Card number with an alternate number for use in the Google Chrome browser and in select Android apps. By enrolling in Amex Virtual Card Number, you acknowledge that Google will keep your Card number on file in your Google account.

When you enroll into Amex Virtual Card Number, you are not enrolling in the Google Wallet for contactless payments.

If you receive a replacement Card with a new Card number, you will need to separately enroll that replacement Card if you wish to continue using Amex Virtual Card Number.

Using Your Amex Virtual Card Number

To use your Amex Virtual Card Number, you must be logged into your Google account. Additionally, Amex may need to take steps to verify your identity from time to time. For security reasons, we recommend logging out of your Google account at the end of each Google Chrome browsing session, especially if you use a public or shared device. You should not share your Google account credentials with anyone or allow others to use your Google account while you are logged in.

The same rewards and benefits of your eligible Card are also available when you use your Amex Virtual Card Number. At this time, you cannot use your Amex Virtual Card Number with Membership Rewards® Pay with Points at Checkout. If you wish to use Membership Rewards® Pay with Points at Checkout, you can use your eligible American Express Card.

Please note that Amex Virtual Card Numbers are not eligible to receive payments from your financial institutions towards paying the balance off your American Express Card account.

Data Usage when You Enroll in Amex Virtual Card Number

In order to enroll in, and each time you transact with, Amex Virtual Card Number, Amex and Google will exchange information with each other in real time relating your Card.

We provide Google with your alternative card number, and may provide Google with transaction data and other relevant information related to your Amex Virtual Card Number for Google to: (i) display your Amex Virtual Card Number transactions and your recent transactions using the Card that you enrolled into Amex Virtual Card Number, (ii) provide you with merchant-specific receipts and offers, and (iii) provide you with searchable summaries, analysis and trends. Merchants also may separately provide Google with certain transaction data relating to purchases made with a Card using your Virtual Card Number.

If you do not want Amex to share your transaction data with Google, you must unenroll from Amex Virtual Card Number.

c) If You Use Push Provisioning

Push Provisioning allows you to add your Card to the Google Pay Properties while you are on an American Express online property (web or app) or a third-party online platform authorized by American Express. To use Push Provisioning, you must be logged into your American Express account or logged into your account on a third-party online platform authorized by American Express where you are presented with the option to save your Card to the Google Pay Properties. By using Push Provisioning, you authorize and direct American Express to provide your Card data, including your account number, to Google for storage on file as a payment option on the Google Pay Properties and Other Google Pay Properties. You are also subject to Google’s terms and conditions when saving your Card to the Google Pay Properties, and please see Section 5 (Third Party Agreements) of this Agreement for more information.

Except as otherwise required by applicable law, we may block, restrict, suspend or terminate your use of any Card in the Google Pay Properties and/or Push Provisioning at any time without notice and for any reason, including if you violate these Terms of Use or any of your Card Member Agreements, Rewards Checking Account Terms, BCA Agreements or other terms that govern your Card, as applicable, if we suspect fraudulent activity, or as a result of the cancellation or suspension of your Card account. You agree that we will not be liable to you or any third party for any block, suspension, cancellation or termination of your use of any Card.

THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

NOTHING IN THESE TERMS OF USE WILL OPERATE SO AS TO EXCLUDE OR LIMIT OUR OR OUR SUPPLIERS' LIABILITY FOR ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW. Federal law and the laws of certain States or other jurisdictions may not allow the exclusion or limitation of certain damages. If these laws apply, some or all of the above exclusions or limitations may not apply to you, and you may have rights in addition to those contained in these Terms of Use.
