ELEMENTS x American Express Spending Rewards Terms and Conditions:

1. The Promotion commences on every Friday to Sunday and public holidays within the period from July 1 to October 31, 2019, both dates inclusive (“Promotion Period”).

2. The American Express Additional Reward 1 (as defined in clause 3), and American Express Additional Reward 2 (as defined in clause 3),  are only applicable to the Cardmembers of American Express^® Cathay Pacific Elite Credit Card or American Express^® Cathay Pacific Credit Card, Basic and Supplementary, issued by American Express International, Inc. (“American Express”) in Hong Kong (“Eligible Cards” and accordingly the “Eligible Cardmembers”). To enjoy the American Express Additional Rewards, shoppers must settle the spending target payment with   American Express Cathay Pacific Elite Credit Card or American Express Cathay Pacific Credit Card within the Promotion Period.3.

To qualify for the reward redemptions, all shoppers are required to present no more than two eligible original same-day merchant sales receipts from transactions made in different shops at ELEMENTS, with a minimum spend amount of HK$300 each (excluding any ineligible spending as defined in clause 6 and excluding the value of any ELEMENTS Gift Vouchers / Category Specific Gift Vouchers / Conditional Gift Vouchers used), with the corresponding electronic payment receipts (credit card, debit card, UnionPay card or EPS payment slip counterfoil). The name on the credit / debit card must be the same as that on the electronic payment slip. Cash and Octopus payments are not eligible. For American Express Additional Reward 1 and American Express Additional Reward 2, American Express transaction slips must be presented together with eligible original same-day merchant sales receipts  . 

5. Handwritten receipts, duplicate, reprinted or photocopied receipts and damaged receipts will not be accepted for the reward redemptions. 

6. Receipts from 3hreeSixty, Mannings, POLYHEALTH Medical Centre or Mainland Coaches, bank charges, membership fee payments, telecommunications services, car parks, wedding banquets, private and corporate functions at restaurant outlets, purchases of cash vouchers/gift vouchers/gift cards and value-adding receipts from any shops or restaurants are excluded from this Promotion and are NOT eligible. 

7. Deposits on merchandise and/or meals are not accepted. For installment transactions, only the first month’s installment payment amount will be accepted. 

8. Receipts used towards the application of ELEMENTS Club membership are not eligible for this Promotion. Receipts used towards this Promotion are not eligible for ELEMENTS Club points registration. Shoppers are entitled to one A “Be Exceptional with ELEMENTS Grand Lucky Draw” entry when redeeming the reward.. 9. To redeem “American Express Additional Reward 1” and “American Express Additional Reward 2”, Eligible Cardmembers must present their Eligible Credit Cards together with same-day electronic payment receipts of Eligible Card slips issued by ELEMENTS shops at 1/F Fire Zone Redemption Counter (next to Mainland Coaches Terminal), 2/F Fire Zone American Express Counter (next to Brioni shop) or 2/F Metal Zone Redemption Counter (next to FRANCK MULLER shop) on the same day. The name on the Eligible Credit Card must be the same as that on the electronic payment slips.

10. To be eligible for the Asia Miles redemption, all shoppers must get an Asia Miles registration form at the Redemption Counter on the same day of purchase, and return the Asia Miles registration form to a designated redemption counter or via email (promoele@mtr.com.hk) within the Promotion Period. ELEMENTS may request to record the personal information of participants who redeem Asia Miles including but not limited to the Asia Miles member’s registered name (including first name and last name) and the Asia Miles membership number for the purpose of processing the offer redemption. Late submissions will not be processed. ELEMENTS accepts no liability for any losses resulting from the inability to credit Asia Miles to any shopper’s or Eligible Cardmember’s Asia Miles account. Asia miles membership is mandatory in order to qualify for the Asia Miles award. To earn Asia Miles, each shopper must present his/her Asia Miles membership number by showing physical membership card or mobile app membership card, and an Eligible Cards at the time of registration. 12. Each eligible sales receipt will entitle the participant to one entry of the redemption only. Gift quotas apply and redemption is on a first come, first served basis while stocks last.

13. Original merchant receipts, corresponding electronic payment receipts of eligible transactions and credit / debit card must be presented on the same transaction date at the Redemption Counter located at 1/F Fire Zone Redemption Counter (next to Mainland Coaches Terminal), 2/F Fire Zone American Express Counter (next to Brioni shop) or 2/F Metal Zone Redemption Counter (next to FRANCK MULLER shop) (open from 10am to 10pm daily). 

14. Asia Miles will be credited to each participant’s Asia Miles account within 8 weeks after the Promotion ends. Only those Eligible Cardmembers whose Card accounts and Asia Miles accounts are valid and in good standing throughout the Promotion Period and Redemption Period will be eligible for American Express Additional Rewards earned through this Promotion. ELEMENTS and American Express reserve the right not to credit any Additional Rewards to such Cardmembers without prior notice.

15. ELEMENTS reserves the right to copy and stamp all customers’ electronic payment receipts (cardholder copies) and original sales receipts (listed with all purchased items) for its records. 

16. ELEMENTS Gift Vouchers and Conditional Gift Vouchers, PREMIERE CINEMAS Movie Vouchers and Designated Tenant Dining Vouchers will be given in fixed denominations. From July 1 to August 31, 2019, all redeemed ELEMENTS Gift Vouchers and Conditional Gift Vouchers are valid till October 31, 2019. From September 1 to October 31, 2019, all redeemed ELEMENTS Gift Vouchers and Conditional Gift Vouchers are valid till December 31, 2019.  The Terms and Conditions of the ELEMENTS Gift Vouchers and Conditional Gift Vouchers, PREMIERE CINEMAS Movie Vouchers, and Designated Tenant Dining Vouchers apply. Shoppers can refer to the back of the vouchers for details.

17. This offer cannot be exchanged for cash or other services or products. All redemptions are non-refundable and non-transferable.

18. ELEMENTS, American Express and Asia Miles Limited and are not the providers of any of these products and/or services herein and make no representation or warranty in relation to the same.

19. ELEMENTS, American Express and Asia Miles Limited shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury which is suffered or sustained, as a result of taking or using any of the offer, except for any liability which cannot be excluded by law.

20. ELEMENTS, American Express and Asia Miles Limited reserve the right to change the Terms and Conditions at any time without prior notice.

21. In the interest of fairness, employees of the merchants at ELEMENTS are not permitted to participate in this Promotion.

22. ELEMENTS and American Express will not accept any liability in relation to any loss incurred by an Asia Miles member’s inability to use any Asia Miles earned.

23. In case of any dispute, ELEMENTS, American Express and Asia Miles Limited reserve the right to make the final judgment and the decision of ELEMENTS, American Express and Asia Miles Limited shall be final.

24. In case of discrepancy between the English and Chinese versions of these Terms and Conditions, the English version will prevail

“Be Exceptional at ELEMENTS Grand Lucky Draw (“Lucky Draw”) - Terms and Conditions: 

1. The Lucky Draw offer is from September 1 to October 31, 2019, both dates inclusive (“Promotion Period”). The Redemption Counters are located on: 1/F Fire Zone, next to Mainland Coaches Terminal; 2/F Metal Zone, next to FRANCK MULLER shop; and 2/F Fire Zone, American Express Counter, next to Brioni shop (all open from 10 a.m. to 10 p.m. daily).

2. For each entry to the Grand Lucky Draw, American Express Cathay Pacific Credit Cardmember or American Express Cathay Pacific Credit Cardmember, Basic and Supplementary, issued by American Express International, Inc. (“American Express”) in Hong Kong (“Eligible Cardmember”) and other shoppers must spend HK$3,800 or above in a maximum of TWO same-day original sales receipts, presented together with the corresponding electronic payment receipts from transactions made in different shops at ELEMENTS, each with a minimum spending amount of HK$300 (excluding any ineligible spending as described in paragraph 4 and excluding the value of any ELEMENTS Gift Vouchers / Category Specific Gift Vouchers / Conditional Gift Vouchers used) and the credit/debit card. 3. Receipts from POLYHEALTH Medical Centre or Mainland Coaches, bank charges, membership fee payments, telecommunications services, car parks, wedding banquets, private and corporate functions at restaurant outlets, purchases of cash vouchers/gift vouchers/gift cards and value-adding receipts from any shops or restaurants are excluded from this programme and are NOT eligible. 

4. Handwritten receipts, duplicate, reprinted or photocopied receipts and damaged receipts will not be accepted.

5. Each original same-day merchant receipt and corresponding electronic payment transaction receipt can be redeemed for one Lucky Draw entry only. This offer cannot be used in conjunction with any other promotional offer. 

6. Eligible Cardmember and participants must provide their full name and contact number to enter the Grand Lucky Draw. Personal data supplied by participants will only be used for the administration of this Grand Lucky Draw. ELEMENTS reserves the right to transfer this information to third parties for identity verification.

7. If Eligible Cardmember and participants refund any purchased products during the promotion period, the Grand Lucky Draw chance will be automatically forfeited. In case of any dispute, the decision of ELEMENTS, American Express International, Inc. (“American Express”) , Asia Miles Limited and Premium Motors Ltd. shall be final.

11. The Lucky Draw will be held on November 5, 2019 and the results will be announced on November 12, 2019 on ELEMENTS’ official website, and in Sing Tao Daily and The Standard. Winners are required to visit the Redemption Counter (1/F Fire Zone, next to Mainland Coaches Terminal) at ELEMENTS to collect the prize or redemption letter with the Lucky Draw ticket on or before December 15, 2019. If the personal details on the winning Lucky Draw ticket are illegible or the winner cannot be reached by telephone on or before November 19, 2019, ELEMENTS reserves the right to assign the prize to another winner. 

12. The Lucky Draw grand prize is a brand new Audi e-tron (1 winner), and 2nd prize is 100,000 Asia Miles (5 winners). The 2nd prize winners must be Asia Miles Members. If the 2nd prize winner is not an Asia Miles member, he/she can enrol for free at www.asiamiles.com. The winner is required to provide valid Asia Miles membership information including name and membership number by December 18, 2019 in order to receive the prize. Any winner who fails to comply with the rules will forfeit receiving the prize. The Asia Miles will be credited to the winner’s Asia Miles account by January 10, 2020. 

13. The retail value of the brand new Audi e-tron (Grand Prize) is HK$1,188,600 (including Motor Vehicles First Registration Tax). The value is for reference only. The government license fee, insurance fee, first registration tax (the incremental first registration tax fee after 1 February 2020) and all related administration fee shall be borne by the Prize winner. The prize is manufactured in 2019, the colour, features and specifications are not available for selection and subject to the final decision by Premium Motors Ltd.

14. All prizes cannot be exchanged for cash or other services or products. All redemptions are non-refundable and non-transferable.

15. Late redemption will not be entertained.

16. Winners must redeem the prize at the designated location in the designated period stated on the redemption letter. Prizes not claimed will be forfeited.

17. ELEMENTS reserves the right to copy and stamp all customers’ electronic payment receipts (cardholder copies) and original sales receipts (listed with all purchased items) for its records.

ELEMENTS, American Express, Asia Miles Limited and Premium Motors Ltd. shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law.
