• Participation in the American Express 0% WISE PAY PROGRAM (“0% WISE PAY”) is governed by these Terms and Conditions,and you will continue to be bound by the relevant Cardmember Agreement. American Express (Thai) Co., Ltd. (“American Express”) reserves the right to change or amend these Terms and Conditions or add new Terms and Conditions at any time. Any such changes or amendments or additions will become effective and binding on you upon The notification to you by any means American Express deems fit. If you do not accept such changes or amendments or additions to these Terms and Conditions, you may cancel 0% WISE PAY by contacting us. However, you will still be liable for all Charges incurred under 0% WISE PAY and all other obligations under these Terms until your Card Account is repaid in full.
• 0% WISE PAY is available to American Express Cardmembers who hold any valid American Express Cards issued by American Express, except American Express Business Card and American Express Corporate Card (“Eligible American Express Cardmembers”).
• 0% WISE PAY is an installment payment program which allows Eligible American Express Cardmembers to elect to settle a Charge on their Account at participating merchants in Thailand for eligible purchases by deferred monthly installments of 3 or 6 months and by completing an installment payment program Record of Charge (“ROC”).
• Eligible American Express Cardmembers can participate in 0% WISE PAY only if: (a) the Charge is THB 5,000 or more at participating merchants in Thailand; (b) the Charge for eligible purchases is solely determined by the participating merchants (including eligible goods and/or services and/or time of purchases that are not specified in these Terms and Conditions.Please contact the participating merchants directly for information on the eligible purchases); (c) The Charge does not exceed the Credit Limit (which shall not include any temporary credit limit increase) on your Account; and (d) your Account isin good standing (including not being overdue) and not suspended or cancelled for any reason. Notwithstanding any other Terms and Conditions, American Express reserves the right to reject any 0% WISE PAY transaction in accordance with our internal assessment policy and American Express also reserves the right to terminate 0% WISE PAY if the Charge exceeds theCredit Limit (which shall not include any temporary credit limit increase) on your Account.
• 0% interest applies only if your Account is in good standing (including not being overdue). If your Account is not in good standing, a finance charge at the applicable rate of interest as set out in your Cardmember Agreement will be assessed from each transaction date on all charges in the statement (including any installment in the statement) and all new charges posted(including any installment posted) after the statement date.
• By signing the ROC, you irrevocably authorize American Express to pay the total amount of the Charge as set on the ROC to the participating merchant and agree you will be liable to us for the total amount of the Charge. The total amount of the Charge will be billed to you in equal monthly installment during the period of deferment (3 or 6 months) selected by you onthe ROC with the first such installment falling on the first statement following the date on which you incur the Charge. If the Charge cannot be divided into equal monthly installments, the difference shall be paid by you together with the final monthly installment. Your Credit Limit will be reduced by the total amount of the Charge upon 0% WISE PAY being approved by American Express and will be restored as and to the extent each installment amount is paid to American Express.
• You can pay the entire unpaid amount under 0% WISE PAY at any time prior to the expiry period by calling us. We will then show the entire unpaid amount under the 0% WISE PAY as payable on your next monthly statement. If you do not inform us that you wish to prepay, we will record the payment as a credit on your Account and accordingly, this credit will not reduce the balance of the outstanding amount under 0% WISE PAY or future installments.
• Any unpaid amounts under 0% WISE PAY shall become payable immediately, upon the cancellation or revocation of your Account or 0% WISE PAY.
• American Express is not the provider of any of the goods, products and/or services offered by the participating merchants, and is not responsible or liable in the event that such goods, products and/or services are not provided or fulfilled by the relevant merchant unless otherwise specified in the Card Terms and Conditions. American Express makes no representation or warranty whatsoever in relation to any goods, products and/or services.
• Notwithstanding anything to the contrary in these Terms and Conditions, any dispute or complaint in relation to a Charge made under 0% WISE PAY or the purchase or fulfillment of the goods, products and/or services offered under 0% WISE PAY (including cessation of a merchant’s business operations) must be raised directly and solely with the relevant merchant.Notwithstanding any current or future claim a Cardmember may have against the merchant, all amounts payable to American Express under 0% WISE PAY shall continue to remain payable unless otherwise specified in the Card Terms and Conditions.
• In the event of any inconsistency or discrepancy between English and Thai versions of the Program’s Terms and Conditions, the English version shall prevail.
